MONDAY MORNING- The Courthouse

After an epic weekend in Cambridge ,Maryland with our friends...we were back in Philly and prepared for trial...The murder trial of Joyce Grace.
 

"Good Morning troops...Donnie Ray and I brought you all hot coffee this morning." said Olivia.

We had stopped at a local coffee shop and purchased the coffees...

I helped her pick up the coffee...I had Olivia's lipstick on my lapel and my cheek..

"Thanks for the coffees." said Beverly, who took a disinfectant wipe out of her purse and wiped the lipstick off my face and my collar....She smiled..  "Had to stop and get a snog huh?" she said.

"Had to...your auntie is just too sweet...I couldn't resist her." I joked.

"Ohhhhhhhhh stopppp it laughed Olivia as we passed out the coffee..

"Thanks Donnie Ray." said Nelson as he took his coffee...

"This weekend was epic wasn't it?" said Josie..

"Oh My God, everybody had such a good time....That wonderful brunch Sunday Morning and then a dip in the hotel pool afterwords...Oh My God..." said Bresha...

She was describing our Sunday there. A Good time was had by all..Saturday Night and Sunday Morning and afternoon.

"It was a great weekend... I loved it...a nice way to get ready for the hell that's coming." said our client 

Joyce Grace as she too sipped her coffee and sat with us...

In the Judges Chambers this morning...Judge Kelly Ann Mercer, the Judge in this case and the Judge in our last case was enjoying an early morning kiss with Lt. Arthur Tragg.

Lt. Tragg stared at her.....

Her lipstick imprints were on his lapel and his face... She took a disinfectant wipe and cleaned off his lapel and his face....

"Now I'm going into court...You come in after you have uh calmed down ." she said and casually exited the Judges Chambers...

II-

COURTROOM A- 9:00 AM

"ALL RISE FOR THE HONORABLE JUDGE KELLY ANN MERCER." said the Bailiff as Kelly Ann took the bench.

"Kelly Ann? She's the Judge?" said ADA Ennis Hunter.  He had said he wanted to practice in her courtroom, but not this soon.

Lt. Tragg sat down next to him.... he smirked...He was Kelly Ann's current boyfriend , sitting next to the fool who let her get away....He really didn't like this man or respect him much...He wanted to punch his lights out...

  We stood with our client Joyce Grace on the other side of the courtroom...

 ''Wow that's got to be uncomfortable...For Kelly Ann..Her ex fiance is the ADA...and her present beau is the arresting officer in the case." said Olivia.

"She should r ecuse herself, shouldn't she?" I asked.

"We would have a good argument for her doing that...but I think she's going to be fair..She always has been." said Beverly...

"We are taking a big risk here. But I'll trust you and your Aunt's Judgement." said Nelson, always a team player.

"Ouuuuuuu imagine that....Your ex and your current boyfriends in the same courtroom on the same case." whispered Josie to Bresha.

"I knowwwwwwwwwww...I'd be very uncomfortable."said Bresha.

"At Any rate...this trial should be interesting."said Joyce.

"GOOD MORNING!! GOOD MORNING ATTORNEYS AND PERSPECTIVE JURORS!I am Judge Kelly Mercer..I see some familliar faces today..... . Welcome to my courtroom....Due to courtroom crowding of cases , we are going to bypass a preliminary hearing...We know that a crime, a henious crime has been committed so we are going to go straight to trial.. I expect, some of you are tired of hearing this...but it is what it is..We are  trying to wind down our case load.. We will have Jury selection today.. Trial could begin tomorrow morning if we seat a jury today.." said Judge Mercer... "We will start today with introductions.." she said.

"Representing the Commonwealth, Assistant District Attorney Ennis Hunter." said Ennis -""But then again, you know that." he thought to himself..

Lt. Tragg looked at him and smirked...A part of him wanted Ennis Hunter to lose this case....He disliked him so much... He of all people thought that making what he saw as a Manslaughter case at worst, A Capitol Murder case was a bit over dramatic on the ADA's part.

.He wanted to see him humbled in front of Kelly Ann...He looked at her with a longing and a hunger..... 

"Olivia Bennett-Alexander Lead Attorney for the defense your Honor." said Olivia.

Kelly Ann knew who she was...We had represented her in a civil suit recently..

"Beverly West-East, Second Chair for the defense your honor." said Beverly.

"Attorney Nelson East for the defense your honor." said Nelson.

''Attorney Josie Boyd for the defense your honor."said Josie.

"Attorney Bresha Billips for the defense your honor." said Bresha.

I sat quietly with the defendent, our client, Joyce Grace, charged with First Degree Murder... I thought her being charged with First Degree Murder was a little harsh...and the state making this a Capital Case (in which they could ask for the death penalty) was a bit over dramatic... A view surprisingly held by Lt. Tragg himself. 

Our client Joyce Grace had never been in any trouble before...She was nervous....her hands shook out of control...I grabbed her hands to calm her down and looked at her soothingly ,like a parent would to a frightened child to calm her down...

''Alright, we are done with the introductions...We can begin with the jury selection..." said Judge Kelly Ann, who reminded me more of grade school teacher than a judge at times...She was pleasant woman, but not to be trifled with.

Ennis Hunter was smart and well prepared...more prepared than most...He knew a little something about Voir Dire and was not going to let Nelson run amok or so he thought.

But Nelson had the slight advantage...Our technology and my brilliant run down of each of the jurors, the way they voted in elections, their jobs, their education level, et al...gave him an advantage.. We knew it all going in..

Bresha and  Josie, his little understudies , Protoge's if you will, both were helping him today...They sat behind their laptops and whispered certain things they had talked about into his ear.. He smiled wickedly....

Nelson got a 10-2 split, including the jury foreman........

"Look at my baby!" said a jubilant Beverly...

"Excellent....Excellent..."said Olivia.

Joyce looked a bit relieved...She understood that the jury was made up of a majority of people we wanted..

Ennis looked a bit put off...He knew all about us there was to know....He had prepared well and yet, we had already bested him....He had never felt so humbled in a trial...He was always self confident to the point of being considered cocky by some...

Kelly Ann was surprised too...She had worked with Ennis, she had never seen him out witted ,out lawyered if you will this soon in a trial..Part of her felt a little sorry for him, but part of her didn't...This wasn't a game, this was serious business..she thought and he of all people should know that.

"OUTSTANDING!!! We have a jury.."said Judge Mercer...Trial will begin promptly tomorrow morning at 9:00 AM, Jurors, Attorneys  Be on time and Be ready for trial." said Judge Kelly Ann Mercer.."You are dismissed." she said, striking her gavel.

Court was dismissed for the day..

.Lt. Tragg  stood outside the courtroom smirking... He reveled in seeing us one up Ennis today....he despised him so much!

Ennis walked out of the courtroom...

"Kelly Ann, perhaps we could uh go to lunch?" he said to her.

"You know I can't do that, you're prosecuting a case in my courtroom...I can't be seen talking to you...And from now until this case comes to a close...I am to be addressed as Judge Mercer....Now Goodbye, have a nice day." she said and she left the courtroom, holding her robe in her hand...Not leaving with Ennis or Lt. Tragg. 

Olivia had witnessed the entire exchange....She applauded. "Well Good for her...She handled this as flawless and as professional as I have come to expect.." she said.

 

"She turned him down for lunch....but she also left Lt. Tragg standing here too.." I said.

"I'm sure that didn't go over well with him...but she's doing her best to be fair and impartial,,,I respect that and I respect her." said Beverly.

"Yeah I do too...She has to play it this way....Either that or recuse herself altogether." said Nelson.

"I don't know...If I were her and in a situation like this....My Ex-Fiance , the ADA and my present boyfriend, the arresting officer....I might recuse myself.." said Josie.

"I might too...It would be pretty hard for me to rule in a case like this...but let's see how it goes."said Bresha.

"I think she'll be just fine..." said Olivia..."Come on, let's go home." she said.

III-

A WEEK LATER-

It had been a contentious trial..

ADA Ennis Hunter was truly a good prosecutor and he had prepared well...

He showed the jury lurid photos of the crime scene and presented the surgical tools that had been luminoled and had traces of blood on them...

On Rebuttal, Olivia and Beverly presented hospital experts who testified that all of these tools were used in different surgeries and despite bleach and hoy soapy water...Traces of Blood from several surgeries could still be found on all of them and it would be impossible under the circumstances to determine which one if any of these were the true murder weapon.

Ennis noted that our client's fingerprints were in the office, all over it..

Olivia and Nelson noted and had expert witnesses come in and testify that the fingerprints of at least 29 people were also found in the office... They were nurses and doctors and they operated on patients in the room. Few if any of these other people were questioned about their whereabouts....

As many ADA had before him, Ennis Hunter glared angrilly at Lt. Tragg for not interviewing or following up on any of the other people in the operating room.

Lt. Tragg looked like he had swallowed a canary..He was embarrassed and livid at the same time..

Ennis pulled out a log that showed our client had been in the office with the victim and witnesses who said they heard screaming and shouting just two hours before the victim was last seen alive..

Josie explained that her client was angry about what she felt was an unjust termination....but that she had left him alive...She requestioned the prosecution witnesses who all said they saw Joyce Grace leaving and had seen the doctor alive afterwords.....

Bresha presented video and photo footage of Joyce leaving the hospital two hours before the doctor was murdered and never returning..

Several witnesses said they saw her leave and that she did not enter the hospital again....

The case was filled with so much confusion that there was literally no proof of just who was in the hospital at what time or not...  It was clear there were many people to choose from...

Ennis knew he had entered a hornets nest with this case.....We had tangled him up not just with evidence but with laws and predicates and references to simular cases that even he was not ready for... At the end of a week he was exhausted...

He stared at me with mixed admiration and anger..

"Now that's what an investigator is supposed to do."he said of me to an angry Lt. Tragg.

Lt. Tragg was livid....Angry the case was going sideways, Angry this man who he despised was pointing out every mistake he had made...and angry that Kelly Ann hadn't seen him in a week, not at her loft and not in the Judges Chambers....He was angry and Horny....A combonation that didn't put him in a good mood.

Kelly Ann had been the soul of professionalism being tough but fair to both sides... Not favoring either side...We couldn't have had a better judge.

"It's Monday, The Prosection has rested it case...I expect to hear oral arguments for the defense Tomorrow Morning....Be on time and be ready for trial...Court is dismissed." said Kelly Ann.

That Night-

At our Office /Duplex-

"Wow this has been one hell of a trial hasn't it? I said.

"I know Kid...Last night should hold me over for a few days....." said Lt. Tragg, watching Kelly Ann walk towards the courthouse without him... He didn't bother to ask for another kiss...He wouldn't have

been able to take it.

"WHAT A WOMAN!" he said to himself  watching her walk away....

IV-

We began our defense...

Olivia reminded the jury that our clients fingerprints and 29 other people's fingerprints were found in that room...All were Medical personnel who worked there....

Beverly talked about witnesses and proof that our client was gone at least two hours before the murder...

Bresha had video and photos proving Joyce was nowhere near the hospital....As well as Credit Card receipts showing what she did and where she went after she left the hospital...

Nelson and Olivia called their next witness...The Only witness they intended to call.

Wally Brietland, the former head of Human Resourcess..

"Mr. Brietland, you worked at that Hospital for 19 years , did you not?" asked Olivia.

"Yes mam!" said Wally Breitland.

"You got fired just one year before you would have been eligible for your pension....Isn't that right?" asked Nelson.

"Yes..." he admitted ,lowering his head...

"Dr. Stephen Cleaver was responsible for you losing your job wasn't he?" said Josie , who showed the jury Complaints against Dr. Cleaver for sexual harrasment...27 complaints by 27 different people that was  largely ignored...You took these complaints from these women, including my client and largely ignored them....This man was never disciplined, except for one minor write up, four years ago.. This man gave my client and several other women negative performance evaluations...It resulted in several of them resigning and my client being terminated...This man ran roughshod and you never did a damn thing." said Josie, getting angry....

"The sexual harrassment was bad enough , but you covered up other things he did too ,like billing, over billing some patients....under billing others...when all that was discovered , you were fired, isn't that true sir?" asked Beverly...

"YES!!! YES!! YESSSSSSSS!" said Wally Brietland, who was crying profusely...

"Here is your phone records..You called him just an hour before he was found dead....You had been fired that day and you were calling him for help....He probably told you he couldn't or he wouldn't help you after all you'd done for him....That made you mad didn't it?  That made you angry...You lost your pension, all those years of work down the toilet, protecting him and he could care less."said Olivia.

"YES YES, YESSSSSS THAT BASTARD, ALL I DID FOR HIM!!!" cried out Mark Breitland.

"You killed him didn't you?" asked Beverly softly....

"I refuse to uh answer any more questions without legal counsel present." he said... He had pulled himself together that much...

"The Defense Rests your honor."said Olivia.

COURTROOM A- 9:00 AM- A DAY LATER!

"Has the Jury come to a decision?" asked Judge Mercer.

Kelly Ann also thought charging Joyce with First degree Murder alone was a bit harsh...She Instructed the jury they could find her guilty of Manslaughter or Second Degree Murder..

''We have your honor" said the Jury Forman.. He passed the verdict to the Bailiff who passed it to Judge

Kelly Ann.

She read it and smiled.She looked relieved....

"Read it" she said.

The Bailiff read it..

"COMMONWEALTH OF PENNSYLVANIA IN THE MATTER OF JOYCE GRACE ON THE CHARGE OF MANSLAUGHTER, WE FIND THE DEFENDENT, NOT GUILTY!!"

"COMMONWEALTH OF PENNSYLVANIA IN THE MATTER OF JOYCE GRACE ON THE CHARGE OF SECOND DEGREE MURDER, WE FIND THE DEFENDENT , NOT GUILTY!!

"THE MOST SERIOUS CHARGE, COMMONWEALTH OF PENNSYLVANIA IN THE MATTER OF  JOYCE GRACE  ON THE CHARGE OF FIRST DEGREE MURDER, WE FIND THE DEFENDENT, NOT GUILTY!!

"OHHHHHHHHHH THANK YOUUUUUUUU, THANK YOUUUUUU!" said Joyce Grace, crying profusely and hugging both Olivia and Beverly..

"You're welcome baby...We knew you were innocent." said Olivia.

"I know you feel relieved....." said Beverly, who with her aunt leaped in the air, high fived and yelled with glee-

"WHOOOOOOOOOOOOOOO WEEEEEEEEEEEE!"

"Thank you so much, for all you do." said Olivia to me...

"That's my job baby, you know that!" I said.

We kissed softly and then more passionately...

''And this is my job, to make sure you are uh compensated!" said Olivia softly.

"Ummmmmmmmmmmmmmm" both of us moaning...in between hot kisses.

"Come here Husband.." said Beverly ,motioning Nelson over to her...

Nelson was tickled pink.....

They too began kissing....

"Ummmm when we got home you're going to put that big ole hard thing in me aren't you?" she asked..

"You know it babe!" Nelson said as they kissed passionately...

"Well ladies , let's take a walk down the street and grab some coffee." said Josie.

"Good Idea...If that food truck is outside...I'm grabbing a Cuban." said Joyce.

"That's a good idea." said Bresha.

And the three girls left the courthouse...

"Hopefully I'll never have to work  with anyone as incompetent as you again." said Ennis to Lt. Tragg.

"The feeling is mutual buddy." said  Lt. Tragg, who disliked this man more by the minute...

Attorney Mark Adams walked up...

"Tough Break today huh?  Have you made a decision to take me up on my offer?" he asked.

"Yes, I'll turn in my resignation tomorrow." said Ennis.

"Good! We'll have your office all set up for you..." said Mark as the two men walked out of the courtroom together.

EPILOUGE-

Wally Breitland was arrested. He confessed to murdering Stephen Cleaver.   He said it was during a heated argument...Which wasn't exactly true...but the prosecution believed him...He was convicted of Manslaughter and sentenced to 10-12 years.

We got Joyce a 1.5 million dollar settlement from the Hospital..... She moved to Washington D.C. ,where she got hired on at another hospital. She writes both Olivia and Beverly from time to time.

Ennis Hunter resigned from the D.A.'s office...He went to work for an LGBTQ initiative firm

with  his friend and new lover, Attorney Mark Adams.....

FRIDAY AFTERNOON-

This Friday ,instead of going to the NO ID BAR, our usual spot, We received an invitation from Millionaire -Entreprenaur, Rollie Rollerson to attend the opening of his newest venture.. a Rooftop  Pool and Bar called ''Wet Dreams"

''Enjoy, Enjoy everybody..."said Rollie as we all sat around the pool and enjoyed our drinks..

Most of us sat outside at tables on the rooftop and observed the pool and those who were swimming...None of us were swimming this afternoon... It was just a nice respite for the weekend.

 There was plenty to drink and the drinks were plentiful.

"I've got to hand it to Rollie, he has really expanded his portfolio over the years....I don't know how many Restaurants and pieces of hotels he's got his hands into." said Olivia.

 

"He's a good client to have." I said.

"He was one of our first clients.." said Beverly.

"He has always been good to us." said Nelson.

"And our friends." said Josie.

"He has certainly thrown a lot of business  our way...All of our ways." said Paris.

"Not to mention nice trips." said Bresha.

"He is indeed a good client to have." said Tony.

Alfreda smiled... She remembered before she started dating Rockland, how she met Rollie at Olivia and Beverly's office and how they really hit it off and they wound up spending two or three nights together..She never ever told anyone about it....Not even Olivia and Beverly..

 "Let's go inside and place our orders."said her husband, Rockland.

There was an indoor Bar and Restaurant....everyone went inside and placed their dinner orders...

 

 "I can smell those steaks from the kitchen." said Yvette.

"They may even rival Curley's I hear." said Gary...

"Ummmmmmmmmm I can wait." said Keith Jones.

"Me neither." said his  wife, Beatrice..

"This is a nice place." said Sofia.

"I know.."said her husband, Kahlil.

"This is a nice alternative on a Friday Night." said Jade.

"It was nice of Rollie to invite us." said her husband, Danny..

Virginia smiled.  Back when she was an Attorney..Long before she met Jetty or most of the people here , She and Rollie had spent a couple of wild nights together...He was something, she thought..smiling to herself.

"Come on Hubby, let's go put our orders in." she said to Jetty,

"Ummmmmmmmmm I can smell those steaks from out here." said Jetty.

We All ordered New York Strip Steaks , Baked Potatoes and a salad..

 

"Ummmmmmmmmmmmmm, everything is just delish." said Jazzy...
 

"Yessssssssssss agreed her husband, Dabnis.

"These steaks may be a bit thicker than the ones at Curley's." said Kayla.

"Mmmmmmmmmmmmmm you might have a point there baby girl." said her husband, Ray.

"This place is so nice and so pretty...I hope it stays open." said Jessica.

If they keep the drinks cheap and serve good grub like this..They won't have a problem." said her husband, Chip.

"I love this place...The Pool, The restaurant, the bar and the great view of the city." said Karen.

"I've got to hand it to Rollie, he has really expanded his portfolio over the years....I don't know how many Restaurants and pieces of hotels he's got his hands into." said her husband, B.L.

"Ummmmmmm this food is so good and it's so relaxing." said Natalie.,

"Yes it is...What a great way to end the week." said her husband, David.

"You're right on both points." said Brooke.

Her husband, Sean was enjoying his food and the view of the city skyline.

As was Zoey..."I'm glad I skipped dinner today...I've got a great appetite." she said.

"Me Too!"said her husband, Lem.

Renee and her husband were busy , feeding each other.

"Ummmmmmmm baby this food is sooo good." said her husband, Tyrell.

Nina Rios and her boyfriend, Carlos Ortiz had once again joined us tonight.

"Ummmmmmmmmmmmmm, everything is just delish." said Nina...

"Ummm , it is." said Carlos.

So we all were surprised when we saw Judge Kelly Ann Mercer ,dressed to the nines and Lt. Tragg walk in..

"Ouuuuuu Arthur this is the nicest place you've taken me yet.." said Kelly Ann....

"A classy  joint for a classy lady." he said. He then scanned the room...To his surprise..he saw all of us, eating and drinking and sitting together, poolside.,

"I DON'T BELIEVE IT!!!  THEY'RE EVERYWHERE I  GO!!!" he exclaimed.

"Arthur....They're just eating and drinking....Just like you're doing...They aren't bothering you...Mind your business and let's sit down." said Kelly Ann softly.

She had a calming effect on him...They took a seat, ordered drinks and food...

"That's another beautiful dress Kelly Ann is wearing....When she's alone, I've got to ask her where she shops." said Jazzy.

"I know right?  You think the good lieutenant is buying her those dresses?" asked Beverly with tongue in cheek.

"He may be paying for them, but he hasn't got tastes like that..." said Natalie.

"I know right? That's a beautiful dress, just like the other one she had on a few weeks ago." laughed Kayla.

"Myyyyyyy what good lovin can buy you. The power of the PANTAYS!" said Renee, which got all five girls laughing..

"Look, everyone is here tonight...There is our former prosecutor, Ennis Hunter." said Olivia.

Ennis and his new boyfriend and partner Mark were sitting in a corner having a meal and drinks as were all of us.

Kelly Ann noticed.  She was happy that  Ennis had found someone...She had heard he resigned from his position as ADA and was working at a private Law Firm that specialized in LGBTQ rights...That was a good move for him.

It was a beautiful night for all involved.
