COURTHOUSE WAITING ROOM- TRIAL DAY!
 

We all sat in the courthouse waiting area drinking coffee.....

''Well this is it huh?" said Toby Tyler, our client....who for the first time in the past weeks looked nervous.

 

"This is it...don't be nervous...I know it's much to ask you, but we have a good defense designed to win you an acquittal at best and a hung jury or mistrial at worst...but not a conviction."assured Olivia.

"It's going to be alright...We've won tougher cases than yours." I said.

Beverly smiled at him as she sipped her coffee...

Nelson didn't look at him...He just sipped his coffee and closed his eyes as the smoke from his coffee

Assistant District Attorney Mellissa Wharton was dressed to the nines and heavily made up..She walked in with her briefcase..

Looking every bit as cocky and confident as we had already witnessed....

She, like us had not read the morning paper or seen the morning news on Television....

She didn't know that her friend and heroin connect, Arthur "Cabby" Cabborelli had been shot to death last night...

His body currently lying in state at the Medical Examiner's Office....

or that his loft had been raided by 

Lt. Tragg and the Philadelphia Police

And DEA Regional Special Agent in Charge, Carol Redding 

and agents of the DEA...

and enough Heroin to juice half of the city...

They found a book with a list of all of his clients in it and how much they paid and on what dates.. Lucky for her...He never kept her name or date listed in his book..her association with him was still secret, save for her appearence on some surveillance video from a few nights before..entering his loft and leaving in the morning...

There was no evidence of who might have killed him....

No, she didn't know any of that.....

COURTROOM B- 10:00 AM

She didn't know that there was a new Judge too...Judge Julie Wong had to take care of some unforeseen business...and switched off with Judge Kelly Ann Mercer the day before..

"ALL RISE FOR THE HONORABLE JUDGE KELLY ANN MERCER!" said the bailliff..

We all rose..

"Take your seats, Take your seats...Good Morning, Good Morning, Good Morning Attorneys and jurors." she said.

She was such a pleasent woman...Olivia, Beverly, Nelson, Josie, Bresha and I all loved her!

I am Judge Kelly Mercer..I see some familliar faces today..... . Welcome to my courtroom....Due to courtroom crowding of cases , we are going to bypass a preliminary hearing...We know that a crime, a henious crime has been committed so we are going to go straight to trial.. I expect, some of you are tired of hearing this...but it is what it is..We are  trying to wind down our case load.. We will have Jury selection today.. Trial could begin tomorrow morning if we seat a jury today.." said Judge Mercer... "We will start today with introductions.." she said.

"I believe we know each other from when we both worked in the D.A.'s office in New York City your honor... Mellissa Wharton, Assistant District Attorney, representing the Commonwealth." said a smiling

Mellisa Wharton...

"Yes, I remember you..." said Judge Kelly Ann Mercer...She remembered that she hadn't always been nice to her, often treating her as if she was looking down on her...She remembered that none of the female Assistant District Attorneys liked her....Much like the situation here, she had heard. 

"Olivia Bennett-Alexander, Lead Attorney for the Defense your honor." said Olivia.

"Mrs. Beverly West-East,Second Chair for the Defense, your honor." said Beverly.

"Nelson East, Attorney for the Defense your honor."said Nelson.

"Mrs. Josephine Boyd, Attorney for the defense your honor." said Josie.

"Mrs. Bresha Billips, Attorney for the defense your honor." said Bresha..

I sat silently beside Toby..

He was dressed in a nice suit and sat pensively....

"Okay...it seems as though I know all of you....Let's begin with juror selection..."said Judge Kelly Ann.

Mellisa thought she was good... In New York she had come to trial with good questions, great questions and had intimidated defense attorneys and usually got the best of them in Voire Dire...

But Nelson was a different animal....Not only was he not intimidated...He had better questions...

with Josie and Bresha assisting him.... He got a 10-2 split....He conceded the jury foreman to Mellissa.

Mellisa  was not happy... She had misjudged Olivia's young associate attorneys...They were very good,very prepared...They surprised her...She made a note not to take them lightly..This made two times they had out dueled her in court..There would not be a third time she noted.

She thought they had lucked up by getting this Judge...Back in New York, she'd always thought of Kelly Ann as a "Lightweight..." a country bumpkin from Alabama that was out of her element..Yet Kelly Ann had moved to Philadelphia and become a Judge...Perhaps she wasn't a lightweight after all.

''Alright...We have a jury.. Trial will begin tomorrow at 9:00 AM in this courtroom...Attorneys, Jurors,please be on time and be ready for trial...you are dismissed." she said.

We all filed out of the courthouse....

It was when she was leaving the courthouse that she saw the newspaper and the headline..

NEW YORK DRUG DEALER SLAIN LAST NIGHT IN LITTLE NORWAY SECTION....POLICE AND DEA HAVE NO CLUES AS TO WHO HIS KILLER MIGHT BE!!!

It was the most contentious trial Kelly Ann had ever been the Judge over...Two brilliant attorneys,

Olivia Bennett-Alexander , Mellissa Wharton, both Ivy Leauge law school graduates, both very well prepared arguing to the point that it almost seemed personal....

Olivia making objections and bringing up brilliant points of law and predicates....

Mellissa countering with her own objections to cross examination and equally bringing up laws and predicates...

Producing nine witnesses....

Nine witnesses ,whose testimonies were completely eviscerated by Olivia's troops...

 Her right hand man, In law, Nelson East....

Her loyal Lieutenant, Niece, Beverly West-East....

and her additional associates, 

Josie Boyd...

and Bresha Billips...

They totally negated her witnesses testimony and challenged the police evidence....which amounted to very little and very circumstantial...

They presented five rebuttal witnesses of their own, who did not break or falter under pressure..

By the end of the week...They had the jury in the palm of their hands and they hadn't begun their defense yet....

Mellissa looked tired, weary.....almost defeated...Never had she faced competition like this in the courtroom..Olivia and company had taken her prosecution from her and made it their own defense...

They appeared more prepared than her....

Kelly Ann thought so....At any rate, this was a brilliant demonstration of law on both sides...A case any perspective law student should have witnessed...both sides brilliantly arguing their case...

I sat with our client Brandon...

He marveled at Olivia, Nelson, Beverly, Josie and Bresha and their self confidence..

Mellissa marveled at their self confidence too and their superior preparation....

It had been a week since Cabby's murder ....and today , she had used the last of the heroin he had supplied her.. She had no idea where she was going to get her next "bump" She needed it...She could feel herself losing it...

 She noted that had the police bothered to check his alibi...He might never have been charged.

I pulled out a 75 inch monitor.....

Beverly showed the jury a traffic cam photo of Toby in his car at a gas station six blocks away that night at about the estimated time of the murder....

Nelson produced two witnesses , who testified they saw him...around the time of the murder...blocks away....

Josie recalled the nine witnesses who testified against him and grilled them, forcing them to admit that they didn't actually see him and were heavilly influenced by what they saw on the TV news.

Finally Bresha produced his phone 

and the GPS, which tracked his movements that afternoon, proving he wasn't present at the scene of the murder...

Olivia gave her closing argument and after THREE DAYS, we rested our case...

All the fight had left Mellissa...She gave a lackluster closing argument....She looked defeated and like she hadn't had any sleep in nights....Her eyes were sunken in and she appeared to shake a bit...She was sweating profusely....She conceded she had been bested in this case.

Judge Kelly Ann looked at her with concern...

"Are you alright ADA Wharton?" she inquired...

and dismissed us... The case was over...It was in the jury's hands now...

"I think everybody is going to do that this weekend.. " said Renee.

"Yeah, we might go grab something to eat at night, but that's it." said her husband, Tyrell.

 "The Jury comes back with the verdict tomorrow....I hope." said Toby...

"I'm sure they will...It's an intelligent jury...and we laid everything out for them to see."said Olivia, who sounded as confident as she ever did.

 

I smiled and put my arms around her and squeezed her tight...

"I hope the jury comes back with the verdict tomorrow...I'm exhausted...We extended a lot of energy during this  trial." said Beverly...

"They will and regardless....This week after brunch...we can go home and Netflix and chill...Maybe go out at night and grab a bite.."said Nelson.

"Yeah that's what Paris and me plan on doing."said Josie.

"Yeah ,some quality alone time.." said Paris.

"I for one can't wait until the weekend.." said Bresha.

"So many of your trials end on Thursday."laughed her husband, Tony.

"Yeah it's almost as if Olivia tailors her defenses like that."laughed Alfreda.

Her husband, Rockland laughed.

 "You know if this bar had music, it would be perfect."laughed Yvette.

Gary pulled out a quarter..."Play something on the jukebox..." he said...

"We Netflixing and chilling Saturday after brunch?" asked Keith Jones.

"I'm taking a nap." said Bee Bee.

"Me too!"said Sofia.

"Maybe we'll get up and go get a bite to eat at night." said Kahlil.

"A new seafood restaurant opened up.."said Jade.

"Yeah it's a few blocks from us." said her husband, Danny.

"Yeah, I saw it the other day when I was coming from the dry cleaners...Jetty, maybe we can stop by there Saturday night and grab something to eat...Bring it back with us." said Virginia.

"Yeah after we take a nap.." said Jetty.

Nina Rios and her boyfriend, Carlos had driven here in a car tonight...They too were planning to stay in this weekend..

The Jury had come to a decision.....Everyone was in court except, Assistant District Attorney, Mellissa

Judge Kelly Ann found this very strange...she had said for all attorneys to be on time and be ready for trial...This was highly unusual...

The Defendent, Toby Tyler and his legal team.. Olivia Bennett-Alexander, Me, the defense investigator, Donnie Ray Alexander and the other attorneys on his team, Beverly West-East, Nelson East, Josie Boyd and Bresha Billips were all here and on time,.but no sign of Mellissa Wharton...

 

"This is odd...Mellissa being late..She's never been late." said Olivia.

 

"Dare I say traffic.." I added..

"No, she didn't want to witness a big loss." said Beverly.

"A win today would have been a feather in her cap...but even she couldn't believe she won this case." said Nelson.

''Would have been, but not today!"said Josie.

"It's 10:15, we've all been here since 9:00 ,I'm horny....I mean hungry..." said Bresha.

It was now 10:20 am...

"Yes your honor we have.."said the Jury Foreman...

"Bailiff!" she said.

The jury foreman passed the bailiff the verdict....and he passed it to the judge..She read it and passed it to the bailiff.

"COMMONWEALTH OF PENNSYLVANIA IN THE MATTER OF TOBY TYLER...WE FIND THE DEFENDENT, NOT GUILTY OF THE CHARGE OF 2nd DEGREE MURDER!" said the bailiff..

"I'd like to thank the jurors for their time and their attention to detail...Your checks will be mailed to you...You can exit through the rear end..." she said.

Toby rejoiced...

"OHHHH THANK GOD!" he said.. "And Thank You." he said.

He hugged Beverly, Josie and Bresha a lot longer than he should have, but they didn't mind..

"Oh you're welcome." said Beverly...

"You're welcome."said Josie...

"You're welcome." said Bresha...

Olivia and Beverly leaped in the air , high fived and yelled "WHOOOOOOOO WEEEEEE" which was customary when they won a big case...

Assistant District Attorney Mellissa Wharton asked for and got a paid leave of absence...She explained that she had a substance abuse problem and she checked herself into rehab....

SATURDAY NIGHT-

Saturday after brunch, none of us went anywhere...We all retired to our homes for rest, relaxation....but Saturday afternoon after six many of us ventured out to a new seafood restaurant for some take out...

We got in Olivia's car and drove the few blocks to it..

"This is a nice place Donnie Ray....Maybe we should take a table and eat our food here." said Olivia.

"I don't care...you guys mind?" I asked.

"No...I don't mind.." said Beverly....

"Then it's unanimous." said Nelson..

This was one of the rare times it was just the four of us...Josie and Paris, Bresha and Tony and Rockland and Alfreda chose to stay in tonight..

The interior was nice...

Judge Kelly Ann Mercer and Lt. Tragg were seated a few tables from us...She smiled and waved at us..We waved back.

"One thing I love about this neighborhood is the shopping malls and the nice small little restaurants like this...." she gushed.

"Yeah....and my favorite people happen to live around here...Geez they're everywhere." Lt. Tragg smirked.. He had heard we won an acquittal...part of him was glad that ADA Wharton had lost... He heard she admitted to having a substance abuse problem and had taken a leave of absence and had checked herself into a drug rehab center...He wish she'd quit....

 

''Well look who's here...Vettie's entire crew except her..." said Olivia.

"Yup! She and Gary decided to stay in tonight." said Keith Jones..

"We've been in bed watching TV and falling asleep ever since we got back from Brunch.."said Bee Bee.

"So we all decided to get up,  get dressed and check this place out.."said Sofia.

"This is a nice place..." said Kahlil.

"It is..." said Jade.

"Mind if we join you guys?" said Danny Ho.

"Of course not...Pull up some seats." said Olivia.

"We had said Thursday that we were going to stop by here and check this place out." said Virginia.

"Yeah, we had no idea all you guys had the same idea..."said Jetty...

Renee and her husband, Tyrell walked in.....
