The Faithless Juror

 WEDNESDAY MORNING-

Judge Demmings wanted this trial ,this case to be over as soon as possible...It had been less than a week and he had us back in court for jury selection...

Nelson was on his A-Game  and ready to do battle with U.S. Attorney Todd Dellums.

But something about him seemed different, Like his mind was somewhere else...He wasn't laser focused as he had been before..

He allowed Nelson to purposely bait and switch him...First making it painfully obvious to see how far we could get, and then subtley...

When it was over, We had all 12 of the jurors we had picked. Incredible...We hadn't expected that...

"Auntay something isn't right...He was much sharper in the last three trials...He put no effort forth to stop Nelson...Nelson was real obvious at first and he allowed him to do whatever he wanted.. What gives?" asked Beverly..

"It's as if something else is on his mind.."said Olivia, who squeezed my hand softly..

''Well I don't know about him...BUT SOMETHING IS ON MY MIND right now!" I whispered to Olivia.

Olivia giggled..

''You are sooo bad...Didn't I take care of you last night?" Olivia asked..

"You did...And that's why it's on my mind.."I laughed..

We nearly broke the legs off that bed and split the headboard the way we were going at it....

Aida was out on a date...With who she didn't say and we didn't ask... Had she of come in unexpectedly, she might have caught us in the living room...in our birthday suits, standing up....me long stroking Olivia.

''Ahhhh you're staying here huh? You know I'm uh up against them in court tomorrow...Jury selection..I must say...I've never been up against a more tenacious group in my life.." he said.

"Oh really? I'll be sure to tell them." said Aida, who giggled..

"You know, Where I'm from...After dates like these , a kiss is usually in order.." he whispered..

"You're from where I'm from, right here in Philly and I never heard that before..buttttttt I guess it's okay!" she said.

This is where his mind was this morning, on last night..He was oblivious to what had just happened..We had picked all 12 jurors favorable to us.

Judge Demmings said-

''Alright, the jury has been picked..Trial will begin again Monday at 10:00 am sharp..Be ready for trial."

he said.

''Well Guys, back to the drawing board...We've got to look at the message we put out , review those witness statements, look over the crime scene photos and Autopsy report just like before."said Olivia.

"I was certain we had outdone ourselves last time.."said Beverly who had grown weary of this case.

''So was I."said Josie.

"But we didn't!!! In all three cases there was someone we didn't convince.. A little less last time, but still....We've got to convince everybody.."said Olivia.

"Ever think about a bench trial Liv?..Yvette and her guys did it and won their case."said Nelson, suggesting we scrap a jury altogether.

"That's a novel idea Auntay."said Beverly.

"With this Judge? Uh Uhhhhhh...we'd lose..But I tell you what!  We get another Hung Jury and we get a different Judge I'll certainly consider it.."said Olivia.

''We going upstairs for lunch?"asked Josie..

''What say you Husband?" asked Olivia.

"Yeah why not? We are here." I said.

II-

After lunch we returned home and had an impromptu meeting in our conference room...Trial was going to start in a few days....

"I looked into our one disenting juror...I looked into all of the disenting jurors from all three trials...It was five in the first trial and four in the second.. I studied their phone calls, their bank accounts from the start of the trial and immediately after the trial...Those nine jurors were legit...but this one..This one in this trial got phone calls from one number from the beginning of the trial..until the end of the trial almost everyday... 150K was deposited in this guy's bank account.. He put it in a trust fund for his daughter who is 14 right now...When she's ready to go to college she'll have that money... Another 150K was put in his bank account after the trial...

He's been in Chinatown playing in a floating crap game practically every night and winning big too!

according to our friend, Eddie Lee... He won 500K a few nights ago and went to Atlantic City... I called some contacts down there...He lost nearly all of that money and returned home to Philly, where he still has a cool 200K in the bank... Not bad for an UBER driver... He's doing quite well... You think I should talk to him?" I asked Liv, She knew I was dying to.

Olivia sighed -"You can, but at this point ,what is the point? The trial is  over...And we are getting ready to start a new trial..What I need you to do is vet every single juror...So that something like that doesn't happen again.."said Olivia.

"I'll Help you."said Beverly...

"I will too!"said Nelson.

"You said he got a phone number from one place...Was it a burner phone?" asked Josie..

"No...it wasn't a burner phone...The call came from the federal building.." I said.

"Hmmm, Maybe I'd better call in some favors.." said Olivia.

Beverly looked at her phone..

"Auntay..we've got to go visit Jerome." said Beverly...

"Yeah let's take care of that first."said Olivia

"Throw me the keys. I'll drive."said Nelson..

The Visiting room in the Federal Holding Center was surprisingly clean and bright..

Our client, Jerome Glenn was glad to see us...He had been one of our rare clients that wasn't granted bail...A tough unfriendly judge with no history with us was the cause.

"Thank you guys for hanging in there with me." he said.

"Jerome we are going to be with you until we get you out of here...Know this."said Olivia..

"Have something to eat Jerome."said Beverly..

"We brought Coffee and Doughnuts and Bagels for you.."said Josie.

She and Josie had brought hot coffee and doughnuts

and warm bagels and cream cheese.. 

Jerome appreciated this.

"Awwwww you guys are the best." he said..

''We got you a better jury Jerome and we've totally vetted this jury...and we are gonna go even harder at the prosecution this time around." said Nelson.

"I'm even looking at the one juror in your last trial, who took a call from the Federal Building and suddenly came into a lot of money from an unknown source before the trial and after the trial..Somebody got to him, but that's not going to happen this time." I said.

"This is the first time I have ever been involved in a trial that was deadlocked more than two times..."said Olivia.

"Usually the Prosecution drops the case or they proffer a deal.."said  Jerome..

"The Only proffer he can make is to drop all of the charges..Other than that..no deal..We aren't going to sell you out like that."said Olivia.

"Thanks...Because I'm Innocent..and I can't let whoever set me up get away with this."said Jerome.

"We can't either.."said Beverly...

''And we may be close." I said.

III-

ATLANTIC CITY- NIGHT TIME!

''You enjoying yourself?" asked Todd Dellums..

"Yes.."laughed Aida..

"Did you tell Olivia and Beverly you were uh going to AC with me?" he asked.

"No...I haven't told them about any of our dates.." said Aida.

"Good, After this damn trial...this never ending trial..I don't care...but for now..I like what we have, you and me...How are you going to explain you not coming there to sleep tonight..?" he asked.

"I'm a Big girl...I don't have to report to Mommy and Daddy." said Aida.

"Yessssssss....Yessssss you are.." he laughed..

They kissed passionately on the boardwalk...

They retired to their hotel room...

That night in their Hotel Room...

  Todd couldn't take his eyes off of Aida

His lights were flashing on and off now..

The bed was squeaking loud now and the headboard was slamming hard against the wall...

EIGHT TO NINE HOURS slowly drifted by....

"UMMMMMMMMMMMMMMMMMMMMMMM!  OHHHH TODDD, you aren't making any
damn sense!  OUUUUUUUUUUUUUUUUUUUUUUUUUUU Myyyy LAWD!"said Aida..

''OOOOOOOU..AHHHHHHHHHHHHHHHHHHHHHH!" moaned Todd.

"KNOCK IT OFF IN THERE...QUIET THE NOISE!!" came the voice from next door and more pounding on the wall...

THREE TO FOUR MORE HOURS PASSED  before Todd came and came hard....and Aida's legs began to quiver and then shake...her head turned from side to side and tears streamed down the side of her face..She was crying like a little girl..

"OHHHHHHHHHHHHHH FOR THE LOVE OF PETE, WILL YOU TWO BE QUIET?" came the voice from next door...

THREE TO FOUR HOURS drifted by....

Olivia had put together an incredible team...Beverly and Nelson were like clones of Olivia.. Donnie Ray was a tenacious investigator and Young Josie was blossoming into a very good attorney.

He should be working on his arguments ...

Instead he was lying here between the big shapely legs of this entrancing new U.S. Attorney...

THAT SAME NIGHT IN PHILADELPHIA'S CHINATOWN-

We were upstairs at Eddie Lee's joint.. Card games were going on...Mostly Chinese and Russian Mobsters were playing..There were a few Blacks up here playing..And some Whites..The police knew about the card game and the floating crap game, but they left Eddie Lee alone..He kept it quiet and peaceful in Chinatown..So what if a few high rollers lost some money?

"You girls know how to play?" I asked. It looked Like Olivia, Beverly and Josie wanted into a  Poker game. The men smiled at the three of them and were all too ready to let them play.

''Poker is one of the cool things my daddy taught me and her.."laughed Olivia as they dealt her in..

"We are city girls Donnie Ray..We weren't lawyers all our lives..Mom Mom would have flipped if she had known."laughed Beverly..

"Oh you know she would have.....Especially you...The babyyyyyyy!" teased Olivia.

"I know..."laughed Beverly... "Alright fellas, deal us in..." she said.

"My daddy was a gangster..He taught me how to play as well."said Josie , who sat down with Olivia and Beverly and joined the game.

"So was my uncle, but this game is too rich for me.."said Nelson..Always the cautious word of wisdom..I liked him being around my girls.

''Then you can stand over here and watch me and your wife's backs.."said Olivia.

"Yeah, come over here baby."said Beverly..

"I'd love nothing better."said Nelson..who simply adored Olivia , Beverly and  Josie to death!

They were his girls too!.

Josie smiled..

All three girls were good card players..

I was laser focused on finding one guy...our faithless juror...He had been dropping a lot of money at the crap table since the trial...

And there he was...Juror number 12, Robert Phillips..Losing badly on the crap table..

"You're havin a bad night tonight fella..You just dropped 50 large ....You did better in Atlantic City last week.."I said.

"How did you know about it?" he said...Then he went to jump up..I pushed him back down...

"SIT DOWN! AND I MEAN SIT DOWN!" I barked.

Nelson walked to the side of him..

"Sit down..." he said quietly..

"You Atlantic City Boys...Look, I paid my debts...We was all square...I don't owe nothin..."he said..He looked frightened..

"Trust me, we aint from Atlantic City.."said Nelson..

"Ohhhhh wait a minute!!!....I seen you before...You're a lawyer...You're uh with that uh lady lawyer and her niece..defendin that guy..." he said, relieved we weren't juice men...

"And this is a subpeona..a court summons...Be there , If you fail to show up...The Police will come after you."said Nelson.

"And being an ex -cop, we hate to have to hunt people like you down."I said and patted him on the back."

''Well Gentlemen, it was great playing with you.." said Olivia as she cashed in her chips..

"I won $5000.00..."she said.

"Me too!"laughed Beverly...cashing in their chips..

"I won $7000.00" said Josie, smiling and cashing in her chips..

The girls were good Poker players...Better than most suspected...

''Smart Ladies...You know how to quit when you're ahead."laughed Eddie Lee.. "A lot of these guys around here could learn from you." he added.  "Donnie Ray, you find who you needed?" he asked.

I tapped Juror number 11, Robert Phillips on the back..

"Oh yeah..." I said.

"Anybody for Jake's?" asked Beverly...

"I think that's a great idea."said Olivia.

"Me too!"said Josie..

"It's unanimous...Let's go  Good night Eddie. Thanks" I said.

"Don't mention it." said Eddie Lee.

"I'm driving...Let's go.."said Nelson..

We pulled off and headed for Jakes, to have one of his fabulous hot dogs.. It had been a good night.

we had found our faithless juror and the girls had won some money at the crap table.
