 PRELUDE- Courtroom A

Judge Elise Cummings was presiding..

The first big surprise was Royce Barnes had a new attorney...Wallace Payton had quit and at the last minute.. he acquired the services of former Assistant District Attorney, Denver Miller.

He looked as though he was a little inebriated when he walked into the courtroom...

"Isn't that Denver Miller?" said Bee Bee.

"Yeah...what happened to Wallace Payton?" asked Keith Jones.

"He's out....He quit.....Denver Miller is in.."said Kahlil..

"Aye Mios Dios...He's drunk!" said Sofia.

"We've got ths puppy locked up !" said Alvin Davis..

"I hate to admit it or sound over confident, but I think you're right." said Yvette....

Tanya smiled..

Denver Miller may have been a little inebriated, but he was still a pretty good attorney, He put up a better fight than we expected, considering he had so little to work with...

 

 

But Yvette, Keith , Bee Bee, Sofia and Kahlil had benefited greatly from a week in Cherry Hill..

They had spent days in the local law library in town...and we had already did our due dilligence as far as jury selection before we left Philly... We came prepared with laws, predicates, laws from simular cases, objections et al...the works...We ran this case like a clinic..

with Alvin Davis doing the clean up work.....

You could see the look of frustration on Royce Barnes face as he faced roadblock after roadblock....

No one was surprised when the Jury ruled in Tanya's favor and found all of the charges to be "frivolous and without merit."

The Press flooded the courthouse after the verdict was read. Tanya addressed the press..

"This is the second time I've had to address baseless accusations made against my good name and the integrity of my office made by this petty and vindictive man, Royce Barnes..The second time and once again his allegations have proved to be baseless and without merit...I hope he'll spend his time actually practicing law and not running for office...an office he lost to me..Such a Petty and vindictive man.." said Tanya.

"We want to thank our friends, Yvette Jones-Lockwood, Keith Jones, Beatrice Evans Jones, Sofia Garcia-Ahmed , Kahlil Ahmed and Jade Lee Ho. from McCluskey/Cozen/Connor and Pratt ..who helped with the defense and who won this case for us.." said Alvin...

 "He just gave us some free advertising guys....I'm so proud of you.."said Yvette.

"Nothing wrong with free advertising...Hey how bout Denver Miller.. He gave a pretty good performance.." said Keith Jones.

"Imagine how well he'd perform sober." said Bee Bee.

''What happened to him? He was once a pretty good lawyer."said Sofia.

"The drinking...he's got to lay off the sauce.."said Kahlil... 

''It wouldn't have mattered in this case.. Their case fell apart...and quick!"said Jade..

Royce Barnes was a beaten man...Twice he'd taken Tanya to court and twice he'd lost...He dodged the press and quickly exited the courthouse...

Meanwhile two courtrooms down in COURTROOM C-   The opening salvos of our case was beginning.

 

We stood with our client, Linda Gorman, who was accusing Jerry Rumsfeld of sexually assaulting her in a restaurant bathroom..

His attorney, Daniel Slade looked mighty confident...too confident...

II-

In Courtroom C- We began our case against Jerry Rumsfeld.

under the watchful eyes of Judge Michael King, a tough but fair judge we had all tried cases under.

Olivia made her opening statement.....A very eloquent statement in which she described our client's harrowing experience in that women's restroom that night and how it has impacted her...She said we were just looking for justice.

Beverly and Bresha called Linda Gorman to the stand...They had been prepping her and briefing her for cross examination and what the oppossing counsel would  likely ask her and how to  respond...They had been prepping her for weeks...

Linda Gorman took the stand... She explained that she had attended Lower Merion High and had then gone to Villinova for her undergrad and Law School...She had worked for two other law firms before working at the Women's Law Center...I was there she met Tanya Mosley and the two struck up a friendship and when Tanya became State's Attorney, she went to work for her as a Staff Attorney..

She was working for her the night she was attacked she said as she began to tell the jury what happened..

Once More ,Linda told her story.

"We were having a meeting at the same restaurant you guys were at that night.....we were talking about getting Yvette and her crew to represent us and fight the baseless charges...All afternoon I could feel his wandering hands running up my legs...and up my dress, rubbing my buttocks and gently pulling on the waistband of my panties.. I again removed his hands firmly...I excused myself and went to the ladies room..

"WHAT ARE YOU TALKING ABOUT?? I\VE NEVER LEAD YOU ON!!! NEVER!!!"   STOPPP, WHAT ARE YOU DOING? JERRY , PLEASE!! PLEASE DON'T DO THIS!!!!" I said loudly..

"RELAX....ENJOY IT BABY!" he said.. He  kissed me......

"JERRY....STOPPPPPPP!  PLEASE!" I begged as he kissed her passionately.....

"UMMMMMMMMMMMMMMMMMMM I'M ABOUT TO BLOW MY LOAD BABY!!! ARGHHHHHHHHHHHHH!" he cried out..

"OH PLEASSSSSSE STOP!" I cried out..

The sink was rocking so hard, I  feared the legs might break...

TWENTY MINUTES LATER!

"Don't you know you're not supposed to be in the ladies room? Oh wait.. MAYBE YOU ARE! HEH HEH HEH!" laughed Jerry Rumsfeld.. It was a slur aimed at Alvin because he is Gay.

Alvin cold cocked him in his jaw....He had had enough of his homophobic jabs and slurs....He despised the man...He had since day one.

Jerry  returned with six lefts and six rights to Alvin's face...Alvin hit him with seven lefts and seven rights to his face and a well placed punch to his solar plexus, causing him to bend and groan in pain before  grabbing Alvin to keep him from throwing anymore punches and spinning him around to prepare to punch his lights out...when the commanding voice of  Ken Anderson was heard..

"HEYYYYYYYYYYYY BREAK IT UP!! BREAK IT UP GUYS!" came the voice of Ken Anderson, getting in between the two men.. "Now what happened here?" he asked.

I ran out of the restroom and I found Tanya and I told her what happened...

She slapped Jerry's face...She called him a dog and she fired him on the spot!" said Linda..

"And that's the truth...that's what happened." she said.

Attorney Daniel Slade sat there with a sardonic grin on his face...We waited, we were ready for his cross examination...We were prepared... He crossed his legs and sat back and smiled.. He didn't say a word.

"No questions for this witness your honor." he said with a satisfied look on his face..

Nelson called Alvin Davis up to the stand.....

He gave his account of the events of the night...They co-incided with what Linda Gorman had said..

Daniel Slade asked him if he actually saw the alleged attack on Ms. Gorman....

He had to admit that he did not actually witness the attack, but that Jerry Rumsfeld was in the ladies restroom where he shouldn't have been..

"BUT YOU WERE IN THE LADIES ROOM TOO!  WHAT WERE YOU DOING IN THERE?" Daniel Slade slyly asked...

"OBJECTION....HE SAID HE WENT IN TO AIDE MS. GORMAN!" said Nelson..

"OBJECTION!! RELEVANCE, ARGUMENTIVE!!!" screamed Olivia.

Daniel Slade smiled, "Question withdrawn.." he said slyly...

Josie called Ken Anderson to the stand...

He testified that he heard punches being thrown and a commotion in the ladies restroom, which is why he went in just in time to see Alvin Jones and Jerry Rumsfeld fighting...He broke the fight up, but admitted he didn't see Ms Gorman being attacked..

"I probably entered the restroom after her attack...but she was gone a long time...States Attorney Mosley sent Alvin to see if she was alright,." he said.

"Seems to me that being a woman, States Attorney Mosley should have checked on her herself..."said Daniel Slade.

"Are you asking a question or making a statement?" Beverly asked..

Daniel Slade smiled snarkily...

"Goddddd you're a sexy little thing, I can't believe so much sexiness is in one family..." he whispered in Beverly's ear as he took his seat...

Beverly gave him a disgusted look...She didn't like the way he was looking at her and sizing her up..Like she was a piece of meat or something. She wanted to slap his face for that remark!

Again, Attorney Daniel Slade sat there with a sardonic grin on his face...We waited, we were ready for
his cross examination...We were prepared... He crossed his legs and sat back and smiled.. He didn't say a word.

"No more questions for this witness your honor." he said with a satisfied look on his face..

His behavior disturbed me the most...He was barely cross examining any of the witnesses...He was barely offering a defense...There was no sense of urgency, I was used to seeing in attorneys in the middle of a case like this...He was acting almost as if he had it in the bag... He was too non-chalant...and that could mean only one thing... HE HAD A JUROR OR JURORS IN HIS POCKET!

Nelson and I looked at the jury ....It could be anyone of them, but who??  I didn't have a clue...Nelson and I had vetted everyone...even the jurors we didn't pick and the alternate jurors.

Judge King recessed court for today.....

Newly vindicated State's Attorney Tanya Mosley decided to take all of her attorneys out for coffee...

at a new place called Coffee Bar...

"This place just opened up... The Manager is a friend of mine... This is an alternative to Sam Mother's Diner and battling with that jackass...Lt. Tragg."said Alvin Davis.

 "Oh Thank you Alvin...I didn't feel like running into Royce Barnes either..He eats in there..."said Linda Gorman.

"Everybody was on point today...but something was off.."said Olivia.

 

"I know...Slade hardly cross examined anybody....I thought for sure he was going to tear into Linda..but he didn't...and he didn't really tear into Alvin or Ken Anderson... I didn't see any urgency in him...You'd think if he's viewed discovery that he'd be throwing flames at everything...but we got nothing.," I said.

"I noticed....It makes me wonder if he's got someone on the jury bending and twisting his way."said Beverly...

"You know I've been thinking that...but I can't put my finger on who, on which one of them.."said Nelson..

"No matter what he does...after tomorrow, he's toast....When we show all of the physical evidence we have...There is no way he can win."said Josie.

"I hope not." said Bresha.

 

 "We were in your courtroom for a little while..You guys were wrecking shop in there."said Yvette.

"Yeah, you were.." said Keith Jones..

''At some point Slade is going to have to plead out, make a proffer.." said Bee Bee.

"If he was going to do that, he already would...He didn't look like he was close to doing that to me."said Sofia.

"Yeah me neither.."said Kahlil..

"He sat there with that sardonic grin on his face though...like he didn't have a worry in the world."said Jade.

"Like he's about to make a move or he already has a move in motion." I said, looking worried.

The coffee in here was really good! Expensive for my tastes, but goo just the same.

So was the pastries.

SAM MOTHER'S DINER-

Nicky Holt like the other 11 jurors all ate their lunches at Sam Mother's Diner... It was paid for by the city...They were given vouchers to use as receipts for pay....

Nicky sat alone, as he always did... He hadn't made any friends on the jury...He was a loner...

A scruffy unkempt gentlemen in a wrinkled suit sat down at his table with a cup of coffee...He had never seen this man before, but the minute he began talking he knew who it was... THE VOICE HE'D BEEN HEARING ON HIS PHONE AFTER HE RECEIVED AN ENVELOPE FILLED WITH PHOTOS....

''Hello Playboy...Just here to remind you that this trial is almost over and you know what you have to do..You are either to convince that jury to vote not guilty or to hang it by insisting on a not guilty verdict, thus insuring a mis-trial......Got it?" came the voice..

"That's Jury Tampering.... You and I both could go to jail behind this." said Nicky...

"Oh Really?  You don't know my name ace! You don't know where I live...You don't know a thing about me...But I know you cheated on your wife...I have the negatives remember?  You got nothin...The girl we used...she's already left town...Your friend, Harry...He's in Atlantic City..probably using his real name...If you don't want your wife to see those nasty photos of you and "Emily" doing the Hibbity Bibbity...You'll bend and twist whatever way we tell you to...Got it ?" came the voice...

He finished his coffee....and got up....not realizing his entire conversation had been recorded on Nick's phone...

He walked up to the counter to pay for his coffee...

Nick snapped a photo of him... He came back to the table..

"See ya Nicky Boy...Remember.. Bend and Twist...You bend and twist the way we tell you until after this trial is over." he said and laughed.

'' We'll see who bends and twists buddy..." said Nicky, who was quick witted and had the presence of mind  to record him and photograph him with his phone.. He resented them , whoever they were for thinking they could throw around money and try to ruin someone's life o get their way....He might still go down, but he had the satisfaction of knowing he'd be taking this clown down with him..

He met in private with Judge Michael King and Deputy District Attorney Lester Burke and passed on his evidence.

"I thank you for your forthrightness..You still feel you can be a fair and impartial juror?" said Judge King.

"Yes your honor...I can be a fair and impartial juror.." said Nicky..

"Good!  You return to the jury..Don't say a word... I'll have this clown picked up....and after this trial I'm going to have Attorney Daniel Slade investigated for jury tampering..." said Deputy District AttorneyJonathan Burke,,,

Olivia gave her closing argument, asking the jury to rule in Linda Gorman's favor...Saying that a great injustice had been done here and that it was the jury's duty to administer that justice!

''Alright..due to the hour , I am going to recess the jury until Monday and  Mr. Slade can begin his defense."said Judge King.

"Oh there is no need for that your honor... I rest my case." said Daniel Slade.

"WHAT?" ARE YOU SURE?" asked an incredulous Judge King...

"YUP!   Yess sir your honor!" said Daniel Slade.

"Mr. Rumsfeld is this okay with you?" asked the Judge..

"Yes, I am in solidarity with my attorney." said a smiling Jerry Rumsfeld.. 

Olivia was stunned... ''I don't believe it.." she said.

 

But I wasn't surprised...The fix was in...I was waiting to see what happened..

Beverly felt as I did... "The only reason he's offered next to no defense is because he's got a juror or jurors in his pocket...look for a mis-trial." she said.

"I don't know Honey Bun....I looked at the jury...Every one of them was disgusted with Rumsfeld and his lawyer...I think we have this."said Nelson.

"Nelson is always so hopeful...I want to go with him on this." said Josie.

"I do too! but I don't know...I've never seen a lawyer not give a defense at all like this."said Bresha.

"Relax kid, we got this one in the box...Either we get a mis-trial and I doubt they'll want to go through this again or we get a full acquittal..."said a very confident Attorney Daniel Slade. Neither he nor Jerry Rumsfeld knew who the compromised juror was, He just knew that one juror was in his pocket.

THIRTY MINUTES LATER-

The jury came back in...

"Has the jury come to a decision?" asked the Judge.

"Yes!" said the Jury Foreman..

"We rule completely in favor of Ms. Linda Gorman.  We agree that she was sexually assaulted and we leave it to the court to decide a monetary payment for her pain and suffering at a later date..." said the Foreman..

The Judge had the jury polled and every single juror agreed with their ruling..

"WHATTTTTTTTTTTTTTTTTT?   I DON'T BELIEVE IT!!!! I CAN'T BELIEVE IT!!! WHAT THE HELL HAPPENED? THAT JURY WAS SUPPOSED TO BE HUNG!!!!" screamed a shocked Daniel Slade, showing emotion for the first time!!!!

"It's going to be a great night for those two...OUUUUUUUUUUUU" she said, laughing... "I gotta stop working so hard and get me a man....they're making me hot." she laughed. She was looking at Beverly and Nelson.

Beverly and Nelson were in the corner kissing like kissing was going out of style.

Juror Nicky Hilton walked past us...None of us knew who he was...None of us realized how he had saved the day by being honest and not bending and twisting to the will of an evil man.

David Halibut, a washed up political operative was arrested and charged with jury tampering and extortion... The tape recording and the negatives were taken from him....

He sang like a chorus...He was given 5 years probation, a $5000.00 dollar fine and 500 hours of community service.

He named Emily Peterson, picked up by the FBI in New York City. She was convicted and sentenced to 3-5 years in Federal Prison. She was paroled in 2 years.

and Harry Hahn, also picked up by the FBI in Atlantic City, New Jersey. He was convicted and given 3-5 years in Federal Prison. He also was paroled in 2 years.

He named Attorney Daniel Slade as his employer... Slade was disbarred and arrested and charged and convicted with Conspiracy to committ Jury Tampering and Fraud. He was convicted and given 5 years in federal prison. He was released after 3 years.

Jerry Rumsfeld was disbarred...He didn't get any jail time ,but was ordered to pay an undisclosed fee to Linda Gorman.

We had our party at The No ID Bar, where we could have a peaceful night without bother from Lt. Tragg or any of the other pundits we typically clash with...
