October Surprise

 Dustin Elba, our former client rang our doorbell....It was 8:45 am.

"Good Morning Mr. Elba...Olivia told me you would be by,.," said Alfreda.

"My God!  You are a very beautiful woman...Are you married?" he said, suddenly starstruck!

"Yes I am...."laughed Alfreda, blushing like a school girl.."And you are also, which is why you're here.," she said, still smiling..

"My wife has been arrested this morning for First Degree Murder and neither she nor the police will give me any information...." he said , frantic... "I need Olivia and Beverly's help....They were my lawyers before,I need them to represent my wife." he said.

"They already are....That's all I'm allowed to say. Come on Inside....Let me fix you a cup of coffee,.,.,Olivia, my daughter Beverly and the rest are on their way to the police station right now..." said Alfreda as Justin came inside...

WHILE DOWNTOWN!

In the "Fishbowl" the nickname the detectives gave the interrogation room... Sabrina Elba exercised her right to remain silent.

After she made her phone call to us...she didn't utter a word...

She was a very attractive woman, Lt. Tragg noted.....

Lt. Tragg played the contents of the zip drive for her...of her late afternoon tryst with attorney Jerome Malcolm...Still she sat quiet.

"You've been a baddddd girl Missy....A Married woman, banging the opposing attorney in your husband's case in the same hotel he was having the litigation in...My my myyyy that takes a lot of nerve...in a room you booked and paid for a month ago...wowww....just two floors under where they were having the meeting...And that little weasel Max Roach found out about it...He was Blackmailing you wasn't he?  Hey look, I never liked the creep either and I personally think you did society a favor by offing him...I want to help you...really I do...Look I know a lot of these ADA's...none of them liked Roach....If it wasn't murder they'd give you a medal....Just write down what happened and maybe they'll go easy on you....Easier than your husband when he finds out the details." said Lt. Tragg..

It wasn't working...Sabrina merely looked at the pen and paper...She didn't touch it and she didn't say a word.

"STILL WITH THE SILENT TREATMENT EH?THEY ARE GONNA THROW THE BOOK AT YOU?  YOU ARE GOING TO BE STRAPPED TO A GURNEY AND YOU'RE GOING TO GET A NEEDLE!!" screamed Lt. Tragg...

"Oh stop being so dramatic Lieutenant." came the voice of Beverly...

"WHAT THE HELL?" said Lt. Tragg, shocked that we were there.... 

"Good Morning Lieutenant....We are here to see our client."said a smiling Olivia.

 

"Good Morning." I said.

"Could we have the room now?" Beverly said as politely as she possibly could.

Nelson, Josie and Bresha said nothing.

"Alright, I see your kids are a lot more polite and respectable this morning than usual..You've got a loser there Liv...We've got her cold..the man was killed in her hotel room, her fingerprints are all over the place and we've got this incriminating video of her...which provides the motive...He was blackmailing her.."smirked Lt. Tragg.

"Thank you for laying the case out for us good Lieutenant....We can take it from there." said Olivia.

He actually left the room without slamming the door...

"Thank you for coming...." said Sabrina.

Josie made the shh motion with her index finger..

"Your Husband is with us...back at our house. He doesn't know anything yet and we aren't going to tell him anything."said Nelson.

"But he will know....my marriage is over." said Sabrina placing her head on the table and crying profusely..

"Now...Now...Buck up young lady....First things first...We are going to get you arraigned...and get you out of here as soon as possible..In the meanwhile, don't talk about your case or anything with anybody..Not cops, not guards and especially not with other inmates."said Olivia.

"Everybody in lock up is looking to make a deal....Remember that!" said Beverly.

"It's going to be alright..."said Bresha, rubbing her back,.,.,.

"It's always darkest before the dawn....Keep ya head up miss." I said. The truth was, she was in a big mess , a big embarrassing mess...and even though I didn't say it...I couldn't see a good outcome. Not at the moment..

"Myyy that was quick!" said Lt. Tragg as we exited the "Fishbowl"

"Have a nice day Lieutenant!" said Olivia.

 

I smiled.

"Have a nice day Lieutenant!"said Beverly...

Again , Nelson, Josie and Bresha said nothing as we all filed out.

II-

At home, we all assembled in our conference room...

 Justin had had his coffee and had been sent home, assured that we would handle everything.

"Okay, so what do we know?" asked my wife, Olivia.

 

"Sabrina rented that room and paid for it, a month in advance....I talked to the maids and the bellhops there... She and Jerome Malcolm met at least twice a week , every week for four weeks...They were very quiet, ordered and paid for food and beverages and always tipped well." I said.

"In order for that weasel, Maxwell Roach to get into that room and wiretap it..He had to be following our case pretty closely..." said Beverly..

"Which means he was hired by someone else,  Possibly Jason McCombs or maybe Dean Harris...you know he was pretty quiet the whole time...the entire litigation." said Nelson..

"You're right Nelson and he probably discovered those two by accident and in addition to whatever he was being paid by whomever....he discovered a Blackmailing opportunity." said Olivia.

"You know that was why his license was revoked two years ago...because he was blackmailing his clients."said Josie.

"If I'm not mistaken didn't he do a stretch upstate for that very thing?" asked Bresha.

"He sure did...He did a year in State Prison and was paroled...for Extortion and Conspiracy...I need to go to his office and look at his files...Tragg and his boys have already been to his apartment...I'm certain nothing is there and somebody found his Safe Deposit Box last night and blew it and all of it's contents up.."I said.

"Well if you can, get on that." said Olivia.  "Meanwhile our client says she was coming to the room with her first payment to him when she found him on the floor, dead....I'm guessing someone else with something equal to hide decided to cancel their contract permanently."said Olivia.

A little while later, armed with a court order and my wife's pretty little niece, who was an attorney...We entered the office of the now deceased Maxwell Roach....

"Shortcake, someone has been here before us...That door was jimmied open..."I said.

"Well from a legal standpoint...I'm glad you didn't have to...Court order or not." sighed a relieved Beverly.

"Shortcake!!! He had files on all of us, everybody involved in that litigation, look..." I said.

There was dossiers on the five of us..

It was Wednesday Night...Beverly and I finished up and headed to Josie's Bar and Grill....Tonight was another special...A Band from a neighboring town and a comedian..

The Joint was jumping again.

We saw our good friend, Bridget Jones there as well as detectives Angela Belton-Barlow and Sirena Pile.

Judge Charlotte Peterson was there with her boyfriend, Eric, newly appointed assistant States Attorney..

.They looked Happy together..

Our people were seated in the center...Beverly and I joined them..

The Band came on...They were from Camden ,New Jersey and they were good...They had everybody up and dancing... They played for two hours straight...

We all sat down as they took a break...

There was plenty of cold drinks and trays of hot crispy fried chicken for the crowd...

"Remember to tip your waitresses "said Honey Brown, who was the de facto manager of Josie's,..,

Gus, the owner and founder of the bar smiled approvingly... He remembered when his bar was a dump and on the verge of closing...and now today was crowded every night and raking in more money than he could ever imagine...with an increased staff of nearly 50 people.. This was largely because of new housing and an influx of young professionals of every race into that housing and new businesses springing up around his bar.

Symphony Sam, the master of ceremonies and house  band leader made an announcement..

"Ladies and Gentlemen, while our band is resting and getting some much needed nouriushment and refreshments..We are going to have a local comedian....She's not only a comedian...She's an Attorney, so if you don't laugh...She'll sue you, Give it up for Karen White...." he said and the crowd clapped and cheered enthusiastically,..

Karen White, an Attorney, our one time adversary, one time client and Nelson's ex-girlfriend appeared on the stage...She saw us and smiled and waved at us...

"Oh No!" said Olivia.,

 

"Oh My God!!! Not tonight!" I sighed...

Beverly was cracking up...and nudging her husband, Nelson... Karen was his ex-girlfriend...A Capable Attorney, but a horrible comedian.

''Stop it...Don't look at me,...I don't have nothing to do with this."said Nelson.

Josie looked at Nelson and cracked up...

"Maybe she got better." said Paris.

"I doubt it,."said Bresha

"I remember our first date...She performed....Oh my god!" said Tony...

"And she still married you huh?   Boy are you lucky!"laughed Alfreda, hugging Tony...

Rockland cracked up..

Karen White  strode on to the stage....

"Well alrighttttttttt! I've got some new jokes...Some new jokes..."she said..

She then went into a rambling monologue that went nowhere.,,The audience groaned.. 

The only difference was this time, no one heckled..At least not to her face...

She went into another rambling monologue that again went nowhere....Not even remotely funny!

The Audience sat stone faced.

"Oh My god, she's horrible."exclaimed Jazzy.
 

"I didn't think she could be worse than she was the last time we saw her in Jersey.." said Dabnis holding his head in his hands.

''Well she is." said Kayla..

"She stinks!" said Ray...

"I'm ready to go home...We had a nice night." said Jessica.

"Yeah the band was good and we do have to go to work tomorrow.Let's get outta here." said Chip.

"Oh my god, she is the most unfunny comedian I have ever heard." said Karen..

"Her stories have no punch line."said B.L.

"Good God... I think I could do better than that."said Natalie..

"I think anybody could without trying." said David.

"Oh this is horrible."said Brooke.

"Yeah the band was good and we do have to go to work tomorrow. let's get out of here"said Sean.

''That's a good idea...She's terrible."said Zoey.

''At least in Jersey she was opening for somebody..somebody good. Yeah let's get outta here."said Lem.

"You mean you've seen her before?" said Renee..

She was so unfunny that her husband Tyrell was laughing..

"Come on Babe,let's go home, we gotta go to work in the morning."laughed Tyrell.

As was Beverly...;.

As Nelson looked as if he could just go through the floor, both embarrassed for her and the fact that he and her once dated.

"This is always a tough crowd in here..always a tough crowd...Nothing can make you guys laugh!"said Karen White..

"If you said something funny maybe we would." came the voice of a heckler..

The entire audience laughed for the first time..

"You know, this isn't easy standing up here telling jokes." said Karen..

"Yeah, you're proving it!" said another heckler..

The audience erupted into laughter..

"Everybody is a comedian! Everybody is a comedian" said Karen...

"Except you!" came the voice of another heckler..

The audience erupted into raucous laughter once more.

"Come Onnnnn give me a break!" she pleaded.

"Give us a break, say something funny!" said another heckler.

The crowd broke into more raucous laughter.

Karen began another monologue that went nowhere and went on for far longer than it should have.

 

 "Oh My God....you know you're bombing when the hecklers in the audience are funnier than you are. The Hecklers are the only ones getting laughs." said Ms. Yvette.

"My god....I didn't think she could get any worse...but she has. Longer stories that aren't funny and that go nowhere..Why don't someone tell her to stick to the law?" said Gary.

"I don't understand...You know she is a pretty good attorney....I've worked with her."said Keith Jones..

''So have I , She's a very good lawyer...She doesn't need to do this."said Bee Bee.

"She sure doesn't.;.because she's bombing."said Sofia.

"Big time...Let's get out of here.." said Kahlil.

"Right behind you."said  Jade.

"Yeah, I gotta work tomorrow..We are out of here."said Danny Ho.

They all said their goodbyes and got up and walked out...as did a lot of other people...

"Oh my god....I can't take any more of this." said Virginia.

"Let's go." said Jetty.

Karen was still starting long monolouges.....Long unfunny monologues and the crowds were simply getting up and leaving...

Soon just Olivia, Beverly ,Nelson and myself were the only ones left...

"Come on Baby...Let's go home..Everyone else is gone."said Olivia,laying her head on my shoulder.

"Okay...I did want to hear the bands last set...but okay.."I said as we got up....

Beverly was hysterical...."You ready to go honey?" she asked Nelson..

"YESSSSSSSS!!!Okay....Okay....you've enjoyed this too much..let's go home."laughed Nelson as the four of us got up and left..

Karen White was finishing up her act....In frustration she said..

"WELL GO THE HELL HOME THEN!!" at the crowds of people who were leaving....

"I don't want that broad to ever perform here again. Half the place is gone..." said an angry Gus to Symphony Sam.

III-

NIGHT COURT- A NIGHT LATER- 8:00 pm.

In Philadelphia, Night Court only operates two nights a week....Tuesday and Thursday, Tonight was Thursday...and fortunately...we got an arraignment date of 8:00 pm. 

The Judge in this case would not be the Judge in the actual case....

The ADA that did show up was not going to be the ADA that tried the case...He had only the basic out line of the case at hand... He basically wanted to go home...So he didn't really put up much of a fight.

Olivia stood with Sabrina, who was calm but a little nervous. She  had never been in Night Court before..Had never heard of it and had never in her life been a criminal defendent, accused of a crime..

This was a truly different  experience for her.. 

She was very fastiduous. Even though she had been in the same clothes for two days...She was clean, smelled fresh and her clothes were unwrinkled.

Beverly sat with her, rubbed her back and told her everything would be alright.

Lt. Tragg was not there... Night court was too low profile for him...No witnesses...No media..and a bunch of  Judges  and ADA's who were mostly older Judges and ADA's about to retire...It was lightweight. It was in session from 7:00 pm- 10:00 pm Tuesdays and Thursdays...We were quite fortunate to get a date.

Nelson and Josie  had presented 10 charactor witnesses..

Bresha followed Olivia and Beverly's lead and argued that Sabrina is not a flight risk...and that she's basically a good person caught up in something that got out of her control...

Sabrina Having no priors and her being the wife of an important area businessman at a reputable firm helped her immensely...She was released on her own recognizance..without bail..

"Thank you guys so much...Oh My god...I'm afraid to go home..." said Sabrina as she walked out of court free for the first time in 48 hours..

"Go Home to your husband....Level with him...That's all you can do." I said to her and hugged her.

It was 9:30 , we all drove her to her apartment complex..

We dropped her off at her apartment complex...where her husband...

Justin was waiting for her...

It was Thursday Night..We weren't going to Curley's for "Couples Night" or Josie's either..We had all been there last night. As far as I knew...This was the rare Thursday Night ,when everybody we knew was at home.

We had been in Night Court...We were tired...We went home.

HOURS LATER-

"It kind of feels good to be home tonight and not out anywhere.." said Olivia.

"I'm Glad we took care of business." I said..

Olivia smiled and fumbled with her phone..She put her phone on the charger by the night stand...

"Then you should be over here taking care of THIS BUSINESS OF YOURS!" she whispered with a giggle.. "You know you've been wanting to all day today.." she giggled.

She was right...I had been staring at her and feeling on her booty all day long..

"You don't have to ask me twice....LAWD!" I said, just staring at her..
