Not So Open And Shut

 Olivia stood in the Judges Chambers, I was behind her....

"Donnie Ray , we've got trial in a few minutes...." she said quietly...

"I know." I said hugging her, squeezing her tight...

"Then don't get yourself all worked up for nothing....We can't do anything right now...." she said.

"I know." I said, taking her in my arms and kissing her...

I ran my hands up her skirt and glared at her rainbow colored thong...

"Ohhhhhhhh myyyyyyy!" I said.

"Donnie Rayyyyyy, cool it!" she said, removing my hands.

Olivia laughed and removed my hands, straightening up her clothes...

"Donnie Ray, come on, calm yourself down...We've got to go to court." she said.

"Yeah ,I know...you're right....Did you buy that thong at the Ms. Lingerie pageant on Saturday?" I asked.

They had had a table in Josie's where they were selling Lingerie, Panties ,Bras, Babydolls for the women who attended.

"I did! Beverly, Jazzy, Kayla and Renee

 bought the exact same one, same rainbow colors...We thought they were pretty." said Olivia.

"Oh they are." I said.

"Sabrina came out...She bought it too and some other pieces...It was nice that she came out." said Olivia.

Speaking of our client..

"Oh they are...They are...and it was good she decided to come out with us that night .Come on,let's go get some coffee."I said.

We walked out to the waiting area of the courtroom where we were served with hot steaming tumblers of coffee...

 

"Ummm, this is good coffee...I've got to find out if they deliver or have a website."said Olivia.

"It is good." said Sabrina.

 

"I hear you found an apartment and in our area..." I said.

"Yes....it's about six blocks away from where you guys live.....I like your area....It has three shopping centers, a movie theatre, nice restaurants, clubs and shops...and transportation... I love it...I signed up for classes at Community College, the campus near you guys and I got a job there...so my tuition is cut in half.." said Sabrina.

''Wow you haven't been wasting your time in our sub-basement. Good for you."said Beverly.

"Well hope you land on your feet.." said Nelson, who still didn't like the fact that she cheated on her husband the way she did and with Jerome Malcolm.

"We are going to get these Murder charges dropped so you can start living your life again." said Josie.

"Yes...." agreed Bresha.

"I wouldn't be so sure of that." said Lt. Tragg who walked in with ADA Gregory Mitchell...''We've got an open and shut case against your girl there...You've got a real loser." he said.   It was the first time he had engaged us in months.

"I'd make you a wager Lieutenant, but I don't want to take your money." said Olivia to him.

"Come on Artie...Let's go inside and get seated." said ADA Gregory Mitchell. 

We didn't know him..

Once inside the courtroom we were surprised to see Judge Kelly Ann Mercer...

We had heard another Judge would be over this case..

"Good Morning, Good Morning, Good Morning Attorneys and perspective jurors. Judge Stephens had a sudden death in his family and I have been asked to take over this case....Case 405 , Commonwealth of Pennsylvania vs, Sabrina Elba on a charge of General Murder..I am Judge Kelly Mercer..I see some familliar faces today..... . Welcome to my courtroom....Due to courtroom crowding of cases , we are going to bypass a preliminary hearing...We know that a crime, a henious crime has been committed so we are going to go straight to trial.. I expect, some of you are tired of hearing this...but it is what it is..We are  trying to wind down our case load.. We will have Jury selection today.. Trial could begin tomorrow morning if we seat a jury today.." said Judge Mercer... "We will start today with introductions.." she said.

"Assistant District Attorney Gregory Mitchell ,representing the Commonwealth Your Honor." he said. 

"Olivia Bennett-Alexander, Lead Attorney for the defense your honor."said Olivia.

 

I sat silent...There was no need for me to say anything.

Sabrina stood by my side...She was an attractive woman, well dressed, smelling good and looking a bit bewildered this morning ,standing in court.. She had never been in trouble in her life.  It showed.

"Beverly West -East, Second Chair for the defense your honor."said Beverly..

"Nelson East, Attorney for the defense." said Nelson.

"Josephine Boyd, Attorney for the defense your honor." said Josie.

"Bresha Boyd, attorney for the defense your honor." said Bresha.

Lt. Tragg couldn't be more obvious that he was enthralled by the Judge..

"VA VA VA VOOOOOOOOOOM!!! WHAT A WOMAN!!!" he whispered to himself....Beet red and trying hard to hide his now massive erection..

Judge Kelly Ann ignored him...She didn't look his way..

""Okay...it seems as though I know all of you....Let's begin with juror selection..."said Judge Kelly Ann.

ADA Gregory Mitchell was good, damn good...He was used to coming to trial with good questions for the jury... great questions and had intimidated defense attorneys of all stripes for years and usually got the best of them in Voir Dire...

But Nelson East was a different animal in court...Voir Dire was his area of expertise....Not only was he not intimidated...He had better questions...He knew the jurors and he knew the kind of jurors he wanted...Those who could think outside the box...Those who might try to fit a circle in a square....

with Josie and Bresha assisting him.... He got a 7-5 split....He conceded the jury foreman to  ADA Mitchell.

ADA Gregory was somewhat unhappy..He knew Olivia and her fellow attorneys were all well educated and somewhat seasoned.. but he had misjudged Olivia's young associate attorneys...They were very good,very prepared...They surprised him...He made a note not to take them lightly again.

''Alright...We have a jury.. Trial will begin tomorrow at 9:00 AM in this courtroom...Attorneys, Jurors,please be on time and be ready for trial...you are dismissed." she said.

We all filed out of the courthouse....

Attorney Jerome Malcolm was sitting in the visitor's section...but he left as soon as court was adjourned..

"Tonight is your first night in your new apartment eh Sabrina.?" said Beverly.

"Yes....It's actually a loft...on the other side of the Shopping Centers.near the movie theatre.. Come see me on Saturday....It has indoor parking for my car...and a nice view.." said Sabrina.

"That's nice...We Will be by Saturday afternoon." said Josie.

"And don't worry , we've got an aggressive defense for you." said Bresha.

Olivia and I would not be returning to the Judges Chambers....Lt. Tragg and Kelly Ann had beat us to it and locked the doors..

''Arthurrrrrrr you really shouldn't be in here with me...and stop staring at me so much during the trial." begged Judge Kelly Ann...

"I can't help it....you drive me wild...I'm nuts about you kid." said Lt. Tragg...

Taking her in his arms and kissing her passionately...

"OUUUUU HOOOOO HOOOO HOOOOOO!" she giggled...She loved that she turned him on so..

"OUUUUUUUUUUUU WHYYYYYYY?? WHYYYYYY?? WHY DO YOU HAVE TO DO IT TO ME SO DAMN GOOD???OUUUUUUUUUUUUUUUUUU!  LIEUTENANT, AWWWWWWWWW LAWWWWD WHYYYYY?" she cried out..

"AWWWWWWWWWWWWW SWEEEEEET BABYYYYYY! OUUUUUUUUU!" he moaned..

The couch was squeaking something terrible..

"Oh My God!  Those two are something else...They're like two cats in heat."laughed Olivia , who was right outside the door.

"She is blowing his mind..."laughed Beverly..

"That sounds like it's going both ways." I laughed. "Come on,let's get out of here." I said.

II-

ONE WEEK LATER-

ADA Gregory Mitchell was very methodical and he laid out his case well that first week.. photos of the crime scene, testimonies of all the CSI, Medical Examiner staff and policemen at the scene of the crime ,evidence that the accused, Sabrina Elba rented the hotel room with the intention of carrying on a sordid affair with the opposing attorney in her husband's legal litigation and the fact that her fingerprints and DNA were found all over the apartment..

He hadn't counted on Olivia , who with her niece Beverly explained that of course their client's fingerprints and DNA were in the hotel room and that they should be there..It was her room. She never denied renting the room, She only denied killing the man  who was blackmailing her.

 

Sabrina sat quietly in between Olivia and Beverly.

Beverly showed the jury the zip drive recording of Sabrina's affair with Attorney Jerome Malcolm and a copy of the note Maxwell Roach sent her saying that she was to pay him 50K or else he was going to make the contents of the zip drive public.   She was a victim of extortion ,she countered..

Nelson cross examined the CSI men, the police, the Medical Examiner office officials on their findings 

and established that no murder weapon had been found on our client's person and there really was no physical or scientific proof that she committed a murder, only thaty this man, Max Roach had commandeered her room and demanded a payment there a day after meeting with her.

Josie showed Credit Card and Debit Card receipts that placed Sabrina blocks away during the time of the killing...

And Bresha frustrated ADA Mittchell with objections based on the law and viable predicates..

One week and his strong "Open and shut case was falling apart at the seems....His brow was wrinkled and you could see the worry in his face..

Lt. Tragg stared daggers at me as the trial began to tank for his side..

I simply smiled.. He hadn't seen anything yet....

ADA Gregory Mitchell continued to press his talking points and plainly made his closing argument...

The jury was surprisingly split, 7 to acquit and 4 to convict and 1 undecided....

"We've got work to do Liv....We've got 7 to acquit, 4 to convict and one undecided...and the Foreman is one of the ones who looks likely to convict." whispered Nelson to Olivia.

"We always have work to do..but we've got two witnesses we are going to call that they overlooked and more evidence that hasn't been presented." said Olivia.

"Donnie Ray has gotten us additional information that the jury hasn't seen or heard yet....We got this

honey bunny." said Beverly ,rubbing his back.

Sabrina looked sad , She hadn't seen her husband, Justin not one day of the trial...Did he hate her that much? she wondered... Jerome Malcolm had been there the first two days of the trial, but had not come again since then....

"Come on, let's go eat." said Josie.

"Yeah...Let's get away from here.." said Bresha.

"This afternoon we'll have a brief meeting after dinner to prepare our defense." said Olivia.

Lt. Tragg looked at them and smirked. He was certain he and the prosecution had an "open and shut " case.

But ADA Gregory Mitchell was a realist...He knew we had done serious damage to his case....He looked at us and shook his head.

We chose to drive up to the Bridge Building.

And have lunch with our friends....Even though Lt. Tragg no longer brow beat us...We still felt like being in a friendly enviroment.

Sabrina had gotten  to be quite popular with our friends.. 

"Sabrina..now that we know where you live...We can all meet up and go shopping some Saturday's ."said Jazzy.

"Oh that would be nice." she said.  She loved our area and she loved the loft she was living in, 

but she didn't plan to stay there permanently...Still she liked having girlfriends to shop with and chew the fat with....

 

"Yeah,Saturday after Brunch at No I.D. Bar , I suppose everybody is just going to go their own way." said Dabnis.

"Pretty Much....I've got some grocery shopping to do and some general shopping." said Kayla.

"In other words we all are hitting the malls." said Ray.

'We are still playing cards at Sofia and Kahlil's house right?" asked Jessica.

"Yeah... after Keith and Bee Bee and Sofia and Kahlil go food shopping." said her husband, Chip.

"What are we doing honey?" asked Karen..

"Netflix and Chill.." laughed her husband, B.L. who was eating with us today.

"I love the way you all eat all of your meals together and hang out together...shop together."laughed Sabrina.

"We've all had some type of past history with each other before we began living together and most of us working in this building."said Natalie.

"Yeah we have a real sense of togetherness." said David.

Brooke was silent, but she certainly felt that sense of togetherness...She loved it..

So did her husband, Sean.

"After Brunch Saturday, I'm going grocery and general shopping with Liv, Alfreda, Vettie and Virginia."said Zoey...

"That's fine by me."said her husband, Chip...."I plan to sleep, catch a ball game." he said.

"We are invited over Sofia and Kahlil's house for Cards and food Saturday." said Renee.

"That's so cool." said her husband, Tyrell.

''What are you guys doing besides getting my defense ready?" Sabrina asked us. 

"Hopefully by Saturday you'll be a Free woman, Saturday, Me, Vettie, Alfreda Virginia and Zoey will be shopping.." said Olivia.

 

"I might take the time to rest..." I said.

"Me, Jazzy, Kayla, Natalie,Brookie, Josie  and Bree

will probably go shoe shopping with you Sabrina and have lunch at the new seafood house.

"With their husbands of course." Nelson through in...

"Yeah, I haven't been grocery shopping in a minute." said Josie.

''We need to go." said Paris.

"I hope it's a nice day." said Bresha.

"I need to gas my car up." said Tony.

 "Me too...I haven't driven it in awhile."said Yvette.

"You and Sofia are preparing the food for Saturday afternoon right?" asked Keith Jones.

"Yeah, Renee and Jade are helping us..."said Bee Bee.

"It'll be a nice night...I don't feel like going out anywhere."said Sofia.

"Yeah me neither."said Kahlil.

"This will be a nice event.."said Jade.

"That's nice, you guys doing that.."said Virginia.

"Yeah , after last week, we all need a wind down."laughed Jetty.

It was the calm before the next storm as we all sat in the Bridge Building's Cafeteria with our friends, eating quietly and peacefully.

It was a rainy day....

We drove Sabrina back to her home..

She loved the lofts...

She had made friends there..

Our good friends, Judge Charlotte Peterson

and her boyfriend and also a resident... Eric Becker...The newly minted Assistant States Attorney...

and Attorney Elaine Young....

They were good friends to have....

She knew that the Judge in her present case also lived in the building...And although she kept her distance.. She couldn't help hearing her and Lt. Tragg late at night through the walls..

"OUUUUUUUUUUUUUUUUUUU...OHHHHHHHHH MY WORRRRRRD!" she moaned...

"UMMMMMMMMMMMMMMM...PUT IT IN...PUT IT ALL IN...OUUUUUUUUU!" she cooed.

"AWWWWWWWWWWWWW SWEEEEEET BABYYYYYY! OUUUUUUUUU!" he moaned..

 

"OOOOOHHH GOOOD LAWD....I'M LOSING MY MINDDD!!OUUUUUUU!" she screamed out..

"OHHHHHHHHHHHHH NELLIE...I'M ABOUT TO BLOW MY LOAD!!!WHOOOO!" he yelled out.

Those two were having a time in her bedroom..

It seemed like every night they were making love......the bed was squeaking and the Judge was hollering to the top of her lungs....

Frankly it was embarrassing , them being so close to her loft...

Especially since the next day she was sitting in court 

with the very professional, tough but fair Judge Mercer....Hard to imagine this woman even having sex...as prissy as she was or seemed....but she was..boyyy was she!!!

ADA Greg Mitchell, who was trying to put her in prison for the rest of her life sat on one side of the courtroom...

and the Judge's boyfriend, the man who arrested her, Lt. Arthur Tragg of Homicide, who was committing murder or worse in the judges bedroom every night sat next to him, making goo goo eyes at the Judge, who was all but ignoring him...

It was obvious he was in love with her...Hard to guage how she felt except when they were at her loft and in bed together.

Her Lawyers, Olivia and Beverly began their defense....They took the jury back over the basic facts...That she indeed did rent the room and for the distinct purpose of having a consensual sexual relationship with Attorney Jerome Malcolm....

They stated that her fingerprints and DNA should be in the room...It was HER hotel room...

They interviewed the people from the Medical Examiners Office, The Crime Scene Investigators and the Police on the scene again.. They had all been witnesses for the State...and now they were our witnesses.. None of them said that they found anything remotely linking Sabrina to the crime.

There was no murder weapon linked to her and little to no proof that she was there when the murder occurred.

Nelson told Olivia he could sense a seismic change in the jury now.. He saw 10 people ready to acquit, 1 person still undecided and only one person to convict......

Olivia smiled and said.. "I told you we had a vigorous and imaginative defense...It's getting through to them.

Josie called Justin McCombs to the stand...

He admitted that he hired Max Roach and that he didn't know his P.I. License had been revoked

or that he had done two years in State Prison for Extortion.... He hired him to get information on all of the attorneys involved in the case and on one person in particular, Dean Harris, the labor negotiator..and Union Official.  Union officials and others had long suspected him of getting kickbacks from different businesses...including our former client and Mrs. Elba's husband..Justin. He said that Mrs. Elba was not part of his assignment.

He told Josie that he gave him information of the Attorneys and Justin, but not on Dean Harris...That was what he had been waiting on when unfortunately Mr. Roach met his death.

"That's because his assignment was Blackmail....He discovered by accident that Mrs. Elba and your lawyer, Jerome Malcolm were sleeping together and he began blackmailing her." said Nelson..

"I suspect he was blackmailing Dean Harris too!" said Beverly...

"I object your honor, Relevance, Proof..." demanded ADA Mitchell.

"We have the proof right here your honor......."said Olivia, producing the zip drive

with the incriminating footage and a copy of the letter he sent Sabrina with instructions on how much money he wanted and the delivery site....Room 509, which he had commandeered.

"I'll allow it." said the Judge.

Bresha, using Sabrina's phone synched into a 42 inch monitor showed the jury everywhere Sabrina went on the day of the murder showing that according to when the Medical Examiner said the murder occurred, Sabrina was six blocks away...and credit card records show she was in an Uber on route to the hotel.

"Meaning my client was nowhere near the scene of the murder at the time it occurred." she said.

Olivia called our final witness... Dean Harris...and asked that he be treated as a hostile witness.

He had never been exactly "Mr. Warmth " to begin with..

"Were you being Blackmailed by Mr. Roach?" asked Olivia..

"I don't know him." he said dryly...

Beverly produced records which I discovered and she and her aunt subpoenaed of payments made to him under the table by several other organizations that were not reported to the IRS...

"Could it be..he found out about this?" said Beverly..

"I don't know....I said I don't know the man." he said.

There was no longer any proof that he had been blackmailed...All of the evidence had been destroyed and he knew it...Still the information we discovered was damaging to him and he knew that too!

He pleaded the 5th a record 25 times.. We got no information out of him whatsoever....but we made our point...Someone else, most likely him, killed Max Roach.

We closed our case and it went to the jury...

"Liv, it's 11 to acquit and one undecided...Look for a hung jury."said Nerlson..

"If that's what we get I'm going to make a serious motion to dismiss the charges...after the jury is polled." said Olivia as we all filed out of court.

IV-

The end of the day.....

The trial for the most part was over , it was up to a jury now....We were home....

Olivia was a little nervous....first time I'd seen her like this....

I put my arms around her and held her tight....

"I know you're nervous....I heard what Nelson said at the trial about the jury breakdown...don't worry about it, you all did as well as you've ever done." I said..

Olivia didn't say anything...She smiled at me....

She slowly and softly kissed me...

She kissed me and didn't stop...breathing heavily and continuing to kiss me...

I slowly slipped her panties down.....

I loved them....Olivia knew I loved them....

I,lifted her up....

"OUUUUUUUUUUUUUUUUUUUUUUUUU!" she moaned....

" I hope we don't get a hung jury....but it's just the way it looked..We even swayed the Jury Foreman and he was the main one looking for a conviction." said Nelson...

Nelson giggled....Took Beverly in his arms..

He and Beverly began kissing...

"I love kissing you." he said.

"I love kissing you too!" she said.

In the courtroom-

Judge Kelly Ann addressed the Jury-

"HAS THE JURY COME TO A DECISION?" asked Judge Kelly Ann.

"Yes your honor we have.."said the Jury Foreman...

"Bailiff!" she said.

The jury foreman passed the bailiff the verdict....and he passed it to the judge..She read it and passed it to the bailiff.

"I'd like to thank the jurors for their time and their attention to detail...Your checks will be mailed to you...You can exit through the rear end..." she said.

"GEEZ! POnce again Auntie and Niecy swayed a jury...Damnnnn!" said an obviously disappointed Lt. Tragg.

"AHHHHHHHHH It's okay Artie....Maxwell Roach was pond scum....I didn't want to prosecute her anyway." said ADA Gregory Mitchell.

Sabrina was stunned....She thought she was going to be convicted or at best a hung jury...She had been acquitted,.She couldn't believe it..

"OH OLIVIA, BEVERLY, DONNIE RAY, NELSON,JOSIE, BREE THANK YOU SO MUCH...THANK YOU....I THOUGHT I WAS DONE!!! OH MY GOD!" she said, tears in her eyes. 

"You're Welcome Baby!  We were a little worried too!" said Olivia.

 

"I was never worried ...I knew you guys had it..." I said.

"Glad you thought so.....I was a little worried."admitted Beverly..

"I  thought we'd get a hung jury...Apparently they got through to that one juror."said Nelson...

"I was up in the air , but I'm glad we won!" said Josie.

"I am too!  We did just a good a job as we have with any other defense." said Bresha.

Beverly and Olivia high fived each other and leaped up in the air...

"WHOOOOOOOOOOOOOOOOOOOOOOOOO WEEEEEEEEEEEEEEE!" they said.

Sabrina looked around...Jerome Malcolm was nowhere to be seen....Neither was her husband...A deep feeling of sadness came over her, but a relief also.. The Murder in Room 509 was over.

Maxwell Roach's murder remains as of this writing still unsolved..

Even though I believe Dean Harris is the actual killer...There was not enough evidence and he was never arrested for any crime..  He was however fired by the Union for accepting kickbacks and indicted on Federal Income Tax evasion charges...Convicted and sentenced to three years in Federal Prison.

CURLEY'S BAR- "COUPLES NIGHT"

It was couples night and as usual, a lot of couples were out tonight and the drinks were flowing..

Sabrina came out with us that night... Her estranged husband was there...

They both were in a forgiving mood.....They sat together at a table , enjoying drinks....talking quietly..perhaps a reconciliation was in the works..

At any rate, they both looked happy.

Judge Charlotte Peterson and her handsome boyfriend, Assistant States Attorney Eric Baker sat at a table together.

While Nina Rios and her boyfriend Carlos Diaz sat at yet another table..

And of course there was our group...We all sat at tables close to each other.. 

"Nice Night tonight...I see Sabrina and  Dustin are over there in a corner talking."said Olivia.

 

"Yeah perhaps a reconciliation is in the works."I said.

"They look happy."said Beverly.

"He wasn't at one trial date...At least Jerome Malcolm came to about three dates." said Nelson.

"You didn't like Jerome Malcolm much did you Nelson.?" asked Josie..

"Can't you tell Jo?" asked Beverly as both women laughed.

"Well at any rate...I hope he doesn't come in here tonight....Sparks would fly.."said Paris.

"You guys would love that wouldn't you?  An all out brawl?"laughed Bresha.

"Yeah that would be funny...We can't depend on Lt. Tragg for entertainment anymore."laughed Tony..

"I know right? Judge Kelly Ann has tamed the beast. "laughed Alfreda.

"The power of true love."laughed Rockland. 

 "The power of the pan-tays." as Beverly can say it " laughed Yvette.

"Whether or not...I have enjoyed these latest "Couples Nights.."  No hassles."said Gary.

"I've enjoyed it too, just me holding my baby in my arms....Nobody staring at me balefully."said Keith Jones, who was holding Bee Bee in his arms..

"I knowwwwww." agreed Bee Bee.

"Tonight he'd be on one...He lost a case in court...Olivia and her team are in here...but not tonight."said Sofia.

"Is he even in here tonight?" asked Kahlil..

"He's in here...They're in here..."said Jade.

"Over in that corner in the back." said Danny...

Lt. Tragg and Judge Kelly Ann were over in a corner kissing really passionately...

Oblivious to the world....

with him running his hands up her skirt...feeling on her fishnet pantyhose..

"They need to get a room."said Virginia.

"Yeah they're getting me hot."said Jetty...

 

"Everything gets you hot..." laughed Virginia..

"This ought to be a nice weekend. We are going back to the shore." said Jazzy.
 

"Yeah to Nelson's Beach houses...First time we'll be going in the fall." said Dabnis..

"We are taking enough food to last all weekend." said Kayla.

"And of course cards and games and music....You know how these Bennett-Women put out an event." said Ray.

"It'll be nice.. Nina and Carlos are coming with us...So is Eric and Charlotte... They have a room in a house around the corner from where we'll be staying..They were invited to party with us." said Jessica.

"Yes....It'll be a good time." said her husband, Chip.

"We always have a good time....I'm so glad I hooked up with Olivia and Vettie and the people around them." said Karen.

"I'm glad we did too babe." said B.L., her husband..

"I'm looking forward to this weekend...I wish Sabrina was coming with us." said Natalie.

"She uh has things to work out on her own." said David.

"I'm looking forward to going back to that club on the Boardwalk." said Brooke.

"You really liked that club huh?" said her husband, Sean.

"I liked that club too!"said Zoey.

"Yeah I did too!" said Lem...

"It was my idea to do a fall trip to the shore...I pitched it to Beverly and Nelson...We all decided to fix one special meal to take.. It's going to be like a pot luck." said Renee.

"Olivia and Beverly loved the idea and we all put it together. Planned it all."said Tyrell.

Olivia smiled ...She looked over at Sabrina and Justin talking.

They looked like they might be reconciling....They were actually laughing and smiling at each other...

It made Olivia Happy.
