John Toilet, On Trial

 PRELUDE- FRIDAY MORNING! Kohner Plumbing supplies.

We walked into the offices of Kohner Plumbing..We were a little early,  Andrew Jano had not come in just yet,..

"This is my wife, Attorney Beatrice Evans-Jones...

Our associates, Attorney Sofia Garcia-Ahmed...

and her husband, Attorney Kahlil Ahmed..." I said.

"And we are here to serve you with a subpoena.. As a hostile witness in the John Toilet Murder trial which begins on Monday Morning." said Sofia.

"WHAT? THERE MUST BE SOME MISTAKE...I DON'T KNOW ANY JOHN TOILET, TO-LAY OR WHATEVER HIS NAME IS." said Andrew Jano.

"You know enough about him sir...." I said.

"We'll see you in court on Monday." said Kahlil.

Andrew Jano looked perplexed.... We had delivered the subpoena today....When he came to court on Monday he'd see that Ms. Jade

who he believed was a Temp named Brenda Hong was actually our investigator...Ms. Jade was off today, so we delivered the subpoena.

Ms. Yvette and her husband, Gary were also off today..

"Good Morning Attorneys...We are going to change things a bit...Due to courtroom overcrowding of cases , and until further notice we are going to bypass a preliminary hearing...We know that a crime, a henious crime has been committed so we are going to go straight to trial.. We will have Jury selection today , right after introduction of the Attorneys..." she said.

"Representing the Commonwealth of Pennsylvania, Assistant District Attorney Brittany Hanks your honor." said Brittany...

Lt. Tragg sat next to her, inching his hand up under her skirt....and smiling that goofy pleased as punch smile..

She removed his hands and shot him a stern look..

Defendent, John Toilet sat pensively.... 

 "Lead Attorney Yvette Jones-Lockwood for the defense, your honor." 

''Assisting her is myself, Attorney Keith Jones." I said.

''Also assisting her is Beatrice Evans-Jones." said Bee Bee.

"Also Assisting her is Sofia Garcia-Ahmed." said Sofia.

''Also Assisting her is Attorney Kahlil Ahmed." said Kahlil.

"Jade Lee Ho, Investigator for the defense,." said Jade.

"Alright , We will have Jury selection today , now that the attorneys have been introduced...." she said.

Brittany was intelligent and intuitive...She was able to give Kahlil and I a battle, but not much...

Kahlil and I got a 7-5 advantage over her and two of the alternate jurors were ours....Not bad..Not bad at all...

"Alright...We have a jury now.... Trial will begin promptly tomorrow at 10:00 AM in this courtroom..

Attorneys be on time and be ready for trial..." said the Judge...

"I'm just glad we got this  trial and going...I want my life back."said John Toilet.. 

 ''And we are going to get it back....The State has no case against you...No case at all." said Ms. Yvette.

"This case may not last this week." I said with some confidence.

"Don't worry John...You'll be off the hook and back at your job before you know it." said Bee Bee.

"This is a very circumstantial and weak case." said Sofia.

"Like most of Lt. Tragg's cases." said Kahlil.

Jade just laughed...

Lt. Tragg saw us all laughing as we left the courtroom...This inflamed him in a way he hadn't been inflamed in a long time...

"Have you interviewed anyone else?   Have you found any forensic evidence? Any?  This case is very weak...These guys are very good....I don't want to look like a fool....Please, please get me something more, anything." pleaded Brittany Hanks..

Lt. Tragg took her in his arms and smiled..

He also saw our client, John Toilet, the man he arrested, laughing hysterically...

"OH MY GOD!!! THAT WAS TOO RICH!" said John.

Lt. Tragg angrily turned and stormed out of the courtroom.....

Judge Julie Wong had also witnessed it...She shook her head and smiled......

COURTROOM D- TUESDAY MORNING 10:00 AM-

The Murder Trial of John Toilet began....

The First Thing I Did was make a motion that all charges be dropped...I brought up the fact that this arrest was based on over zealous policing...I brought up Gyp Riley , who my client was also accused of killing and how further investigating determined that my client was miles away gassing his car as proved by Credit Card Receipts, Gas station Camera Video, a young lady who he was with , who was prepared to testify and a policeman who gave hi a ticket... My argument was that just as overzealous police work resulted in one false charge, it more than likely resulted in the second charge...

This was a bold move and it was kinda dirty pool.. considering ADA Hanks was gracious enough to drop the charges on Gyp Riley..but my main target was Lt. Tragg...I wanted to really stick it to him ,but he wasn't here..He was absent from court today....and he'd be absent the rest of the trial.

Judge Julie Wong smiled...She thought it was an impressive argument, but she refused to dismiss the charges..

Ms Yvette told me she was proud of me for trying something so bold and imaginative, even though she figured it wouldn't work, still it was enough to throw Brittany Hanks off of her game....

Brittany Hanks argued that John Toilet was an angry man and a heartbroken man...and that Melody Tolson had broken off their engagement just three days before they were supposed to be married and that as a last resort...he murdered her....He staged it to look like a suicide.

Bee Bee and Sofia were annoying enough the next few days with their numerous objections and predicates and laws quoted from simular cases 

By day three, Brittany looked bewildered....She knew she was losing the jury.

Kahlil kept asking for fingerprints, DNA evidence...one eyewitness who could place our client anywhere near the scene of the crime......and there was none...

Lead Attorney, Yvette Jones , sat back, almost yawning...and why not?...Her young associates were doing a great job of poking holes all over her case...She didn't have to do or say anything.. She had trained them well... She looked at them like a proud mother...

Brittany was nearly tempted to use jury nullification...but she didn't...She closed her case, stating that our client had no alibi ...and being at home ,alone sleep at the time with no witnesses wasn't proof of innocence either.. A good closing argument.

Her anger at Lt. Tragg increased with every minute.....Yet she wondered as did we...Where was he? He wasn't at the trial at all..

We even ate in Sam Mother's Diner a few days and he wasn't there.. Never came in...It was heaven...

It didn't matter...This trial was only going to last one day more, Ms. Yvette promised.. We only needed one witness to call.

We all went home that night , feeling pretty pleased with ourselves..

And at Ms. Yvette's house...

"I'm all yours tonight babyyyyyyy." Ms. Yvette laughed, looking at her husband..

Yvette ,for the first time in this trial, got out of her seat...She called the only witness we would be calling ,the only witness she would need , Andrew Jano, the Vice CEO of the Kohner Plumbing Company, which was trying to leverage a buy out of Toilet Plumbing and Supplies...and had already acquired several other Plumbing companies....She presented evidence of a lot of Market evidence he had received and used against these companies....Evidence he got through industrial spying...Evidence he got from Gyp Riley, a sleazy Private Investigator, who using a series of fake identities infiltrated these companies with the help of Melody Tolson, real name, Emma Strunk , a former prostitute with a record 17 arrests for soliticitation.....She seduced several of these companies top executives and spoon fed Andrew Jano vital and highly confidential information....Helping his company rise steadily...

And then there was a problem...a big problem...Melody Tolson fell in love, actually fell in love with John Toilet and refused to do Gyp's bidding.. Gyp could no longer control her...She wanted to stop, plus Gyp began blackmailing Andrew Jano and so Andrew Jano put in a call to a man named Finis Henderson, a high priced hitman....

Henderson killed both Gyp Riley and Melody Tolson, Yvette coceded at Andrew Jano's bidding.

"You don't have a bit of proof of these wild allegations....I had no one killed." Jano said.

"Oh but I do..." said Yvette...

Sofia, Jade and Bee Bee pulled a 75 inch monitor out and showed the jury a recorded conversation between Andrew Jano and Finis Henderson....

"Mr. Henderson....Thank you for your patience... As you'll find out if you call the bank in the Caymen Islands. 2 Million dollars was sent to your account for the Gyp Riley hit...and another 1 million for the girl...That was a nice job you did staging the suicide...but it didn't fool the cops." said Jano..

''Doesn't matter...They arrested John Toilet of all people...charged him with both murders...He doesn't have a clue.." said Mr. Henderson..

"I know...hahahahahahahahahahahahahaha"laughed Mr. Jano. ''So what are you going to do now that your work for us is over?" asked Mr. Jano.

"I'm going to Europe.." he said..

(CLICK!)

"Mr. Henderson was arrested in London yesterday by Interpol and handed over to the FBI." said Kahlil.

"He's cutting a deal right now to implicate you and thus save himself from the death penalty...." I said.

"He says he killed both Gyp Riley and Melody Tolson on orders from you Mr. Jano and with that, The Defense Rests!" said Ms. Yvette.

"Your honor, if it please the court...Due to the preponderance of evidence pointing in another obvious direction...The Commonwealth drops all charges against Mr. Toilet." said Brittany Hanks.

 It wasn't a loss....but it wasn't a win either...Brittany had rightfully dropped the charges...If this had gone to the jury, she would have most certainly have lost.  She avoided that!

She was glad Lt. Tragg was nowhere to be found...Her anger at him was high right now....If he had of been here, she might have slapped him again.

''Excuse me...It's pronounced To- Lay....It's French." said John Toilet.

"Oh I'm sorry Mr. Toe-Lay!" said Brittany...

Judge Julie Wong couldn't help herself.. She hung her head down, trying to hide the fact that she was laughing...

"The Court Agrees, all charges against Mr. Toe- Lay are dismissed...Bailiff, take this man into custody.."she said,pointing to Andrew Jano.

"You Guys are great, you got me off!" said John Toilet, happy to be exonerated and a free man...

 ''We told you we would...That's what you paid us for." said Yvette, smiling

"You can go home John and go back to running your company." I said.

''Pick a better class of woman in the future." said Bee Bee.

"Her not marrying you was the best thing that could have happened to you."said Sofia.

''Yeah man..Find you someone who will love you right."said Kahlil...

''What are you going to do about your uh name?"asked Jade.

"My Name is actually John Benjamin Toilet....I'm going to legally change the spelling of my last name to Tolay and drop my first name completely....My name will be spelled the way it sounds and I will here to for be known as Benjamin Tolay.....Sounds a lot better than John Toilet." he said.. 

 "I think that's an excellent idea."said Ms. Yvette, smiling..

"Benjamin Tolay....Sounds good man." I said.

"It sounds sexy." said Bee Bee.

"I like it.." said Sofia..

"Yeah, me too! Benjamin Tolay..." said Kahlil.

"Bravo!" said Ms. Jade..

As we all stood in the courthouse waiting area smiling and talking.

EPILOUGE-

Hired Killer Finis Henderson was arrested in London by Interpol and returned to the FBI, who brought him back to Philadelphia to stand trial for the murders of Gyp Riley and Melody Tolson...He confessed and excepted a deal... He testified that Andrew Jano was the mastermind and accepted a 10 -30 year sentence...with no chance for parole until he at least served 10 years...

Andrew Jano wasn't about to serve any time in prison...

He was found hanging in his cell just a day before he was to be sentenced...His death was ruled a suicide...

FRIDAY NIGHT- THE NO ID BAR!

John Toilet ,now Benjamin Tolay partied with us at the No ID BAR  the night of his exoneration.....

"This is so much fun Ms. Yvette...You know I walked over here a few nights when I was staying at the hotel..; Nothing but hipsters.....You guys make it more fun." he said.

 

 ''We make everything more fun when we show up. We 've managed to peacefully co-exist with the Hipsters.." said Ms. Yvette, laughing...

"Heyy I hate to bring him up, but has anybody seen Lt. Tragg at all this week? since Monday?" asked Gary.

"Come to think of it...No, I haven't...We've eaten Breakfast and Lunch at Sam Mother's during the trial and he wasn't in there at all..We actually enjoyed our meals." I said, smiling.

"We were all in Curley's last night for Couples night and he didn't show at all..We had one of the most mellow nights I can remember."said Bee Bee.

''Ever since ADA Hanks slapped the hell out of him...He hasn't been seen...He certainly wasn't in court." said Sofia.

"You think he's dead?" asked Kahlil..

"We couldn't be so lucky...."scoffed Jade.

"He's not dead!!! He called in Tuesday and asked for a few days off....Nobody misses him..Of course it was granted.I think he left town."laughed Danny Ho.

"You're right about that...Nobody Misses a pain.I hope he stays where ever he is."laughed Virginia..

"Are you wearing that Black lace bra...with the matching panties?"

"Last night was so nice... Without old deputy dog in the house...We were actually able to have nice quiet conversations.." said Natalie to her husband, David..

"Yeah, I could actually feel you up in peace." her husband , David joked.running his hands up her skirt and feeling her legs.

'"Like you're doing now huh?  You are soooooooooo nasty...."laughed Natalie...

"Come here and get some of this sugar." she said...

"Ummmmmmmmmmmmmmmmmmm" he moaned.

As she and David began to kiss each other passionately....

"I'm going with Natalie and the girls to the shopping center to pick out patterns for the dresses we will be wearing in Renee's wedding." said Brooke.

''I'm gonna be playin ball with the guys.."said Sean...So happy that the two of them found a community where they were accepted and not ostracized...and that his Brookie actually had girlfriends, real friends..

"I know you're going to be playing ball tomorrow with the guys after brunch...Guess I'll hang out with Liv and Vettie"said Zoey....

"Yeah.....Maybe we'll all go to Josie's tomorrow night..see what's kicking..." said Lem..

It was 1:30 AM....Our buses would be arriving soon and we all would be leaving..John Toilet decided to leave too, To walk back to his hotel.

"I'm leaving now Ms. Yvette....I'm spending one last night in my hotel room...I'll probably be checking out tomorrow morning...Thank you again for everything..."said John Toilet....Now Benjamin Tolay..

"You're quite welcome.....Good Luck....Be well John." said Yvette as she watched him leave the bar and head back to his hotel...
