Unwilling Vindication

COURTHOUSE WAITING AREA-DAY ONE OF THE TRIAL!
 

"COFFEE'S EVERYONE!" said Bee Bee.

"Get em while they're hot." said Sofia.

"Thank you ladies." said Ms. Yvette.

"Oh God Bless you girls...Just what I need." Said Ellie Mays, our client.

"Ummmm I love that smell." I said as I was passed my coffee.

"I know , fresh coffee beans." said Kahlil.

Jade didn't say anything...She smiled and silently took her coffee..

"Do I get one of those?" laughed Attorney Jason Smith, who just happened to show up or that was what he would have us believe.

"You seem to be showing up quite a bit....Especially around this case....Don't you have any work to do?" asked Yvette with a smile.

''As a matter of fact,I do not! My docket is clear for the time being...So I felt as if I should come down here and watch the Master at work...Mrs. Yvette Jones -Lockwood, Mentor and teacher of young attorneys.." he said looking at the four of us..

We all had graduated Law School around the same time...and passed the bar around the same time too!

He had started at McCluskey/Cozen/Connor and Pratt, a little before us and we had all moved up the 

line together...We all were Senior Associates.. 

Unknown to us at the time....He had packed an overnite bag and was practically living with Ellie Mays

at the holiday Inn, just blocks from us.

Lt. Tragg walked in with Prosecutors, ADA Mandy Addison and ADA Marvin Ortiz.

He stared Balefully at all of us.

"Hi Yvette." said Mandy..

"Hey Girlfriend." said Yvette.

"Wait! You Know Yvette?" asked Lt. Tragg.

"We were in Law School together....I've known her for years...She was a bridesmaid in my wedding...Her and Olivia and Karen Page." said Brandy.

"Hey Keith, Kahlil..." said Melvin Ortiz...

"Hey Man." I said...

"Hey Melvin!" said Kahlil.

"We've played intramural basketball in the spring and summer." said Melvin Ortiz.

Lt. Tragg grimaced. He didn't like it when the Prosecution and the Defense were so chummy!

COURTROOM B-

We had a new Judge, Allan Stiers.

"Good Morning Attorneys, perspective Jurors...I am Judge Allan Stiers....We can begin with an introduction of the Attorneys.'' he said. He was no nonsense and looked and sounded like a college proffessor.

"Assistant District Attorney Samantha Addison , representing the Commonwealth." she said.

"Assistant District Attorney Melvin Ortiz, representing the Commonwealth your honor. " he said.

 

 "Mrs. Yvette Jones -Lockwood,Lead Attorney for the Defense." she said.

"Keith Jones, Attorney for the Defense." I said.

"Mrs. Beatrice Evans-Jones, Attorney for the Defense." she said.

"Mrs. Sofia Gracia-Ahmed, Attorney for the Defense." she said.

"Kahlil Ahmed, Attorney for the Defense." he said.

Jade and our client, Ellie Mays sat quietly...

''Alright, we can start with Juror selection right now.."said the Judge.

ADA Melvin Ortiz had been around awhile and was a whiz at Jury selection...He had very good questions...

But Kahlil and Myself had been around just as long and we also had good questions...We also had Sofia and Bee Bee assisting us on their laptops..

We had actual jurors targeted and questions for them based on education, politics, age, race et al...

We battled to a 7-5 split going our way...a Narrow victory for us...

"OUTSTANDING!!   Alright...We have a jury....Trial will begin tomorrow at 9:00 AM Sharp...

Attorneys, Jurors be on time and be ready for trial.  Court is dismissed. " said Judge Stiers.

''Well Here we go! huh?" said Ellie.

 

 "We are going to get you out of this...I promise you, We can prove 100 percent that you're innocent."said Yvette.

"Let's grab some breakfast." I said.

"Sam Mother's Diner?" asked Bee Bee

"Yeah, I don't care.."I said.

"It's alright with me." said Sofia.

"Me too!"said Kahlil.

"Yeah, Me too!" said Jade.

"We have a quorum!  Let's go folks." said Yvette.

Apparently, A lot of us had the same idea....Grabbing a bite to eat at Sam Mother's Diner.... ADA Melvin Ortiz and a young woman were standing in the doorway kissing passionately..

 "Pleased to meet you." said Yvette, who took out an Anti-septic wipe and wiped her lipstick smears off of his shirt and the side of his face..

Our client, Ellie Mays smiled...

"I didn't know you were married Melvin." I said.

"We haven't seen each other in months...You guys have been on the go...Cancun, the Beach....Justine and I got married about six months ago... She worked and paid my way through law school several years ago and I always said I was going to return the favor in kind as soon as I got on my feet and started making some money.  I'm paying her way now...She's in her second year at Middleton School of Law in Bayside...She's got one more year to go... We decided to get married and set up house and uh here we are."said Melvin..

Jade smiled.

Watching all of this was Lt. Tragg...He didn't like to see Prosecutors and Defense Attorneys being so chummy and comfortable with each other....

Bruce Greene was also in the restaurant watching and listening...He didn't know Melvin Ortiz was married either, but now he did and now he knew he didn't have to compete with him for Samantha Addison. He was overjoyed.

COURTROOM B- A DAY LATER-

Samantha "Mandy" Addison was a very good prosecutor..She didn't lose much...She had won 88 straight cases ,dating back a few years... She was a very articulate woman and gave an excellent sumnation of the incidents and situations that lead according to her , a desperate and "distraught wife to the brink of insanity"causing her to kill her husband and his mistress in cold blood at the Marriot hotel...

She showed the shocked jury large glossies of the lurid and bloody murder scenes......for shock affect and vowed to create a timeline to prove that Ellie Mays, the younger wife (by 13 years) of Investment  Banker Broderick Mays shot and killed him and his girlfriend, a cocktail waitress and how she was the second mistress he entertained...

She may not have realized it...but she was kind of winning the jury over to our side.. Some of our jurors, the women were actually sympathizing with Ellie.

Yvette in her opening statement gave a simple rebuttall... She said Yes it was true that Ellie Mays suspected her husband was cheating on her, in fact knew he was cheating on her...but that she didn't kill him for the simple reason.....She wasn't there. It was a simple statement....

ADA Melvin Ortiz called Private Investigator and our friend, who sometimes did work for us., Milt Lewis.

Milt Lewis testified that Ellie Mays hired him to follow her husband and see what he did.. He had photos of her husband with Kim Belle, not the murdered woman, but another woman he was keeping time with at her apartment and in hotels in Philadelphia and Cherry Hill and even one weekend in Washington D.C.  He had Credit Card and Debit card receipts  as well as photographs...

We had no questions for him...

To our surprise....They called Attorney Jason Smith from our firm who testified that he was her attorney and that he had filed articles of seperation for Ms. Mays and was preparing to file papers for divorce before the murder...

We had no questions for him at the time...but it would have been nice if he had given us a heads up and told us he'd been subpoened..

The next day Samantha called two witnesses...

Bee Bee and Sofia questioned them on cross... Comparing what they had said now to what they had initiallally told the police in the hotel right after the murder...particularly what did they hear first, screams or gunfire and when did they hear it.. They both were completely confused...

 

Samantha called another witness....This was the eye witness who saw the killer running down the hall..

She got the height of the assailant wrong and the description of a dark trench coat wrong....

We brought up the fact that Lt. Tragg and his men did not find any such trench coat in our clients apartment.

Samantha explained all of that away saying that naturally Mrs. Mays would have discarded the trenchcoat and the murder weapon.....She gave her closing sumnation after three days of testimony and asked the jury to find Ellie Mays guilty of two counts of First degree murder.

It all looked open and shut....

 

 "Mandy was as I remembered her from law school, Articulate, Eloquent and to the point...She didn't mince words....but she's going to lose this one...So don't worry...Our turn is next.."said Ms. Yvette.

"She was good...and so were you guys...but I'm afraid she's got the jury where she wants them."said Ellie Mays.

"Yeah for now....but we haven't presented our defense." I said.

"And when we do...Watch how we turn it around."said Bee Bee.

"Yeah just wait."said Sofia.

"We got this on lock."said Kahlil.

"Yvette....I went with those detectives...They had a warrant...We hit pay dirt.."said Jade.

"GOOOD!  This is even better." said Yvette...

"Looks like you've met your match this time Vettie...She's good."laughed Lt. Tragg.

"Yes she is...but so am I...So are we...Don't count us out yet." said Yvette, smiling...as we walked off..

Lt. Tragg smirked as we all walked away...

"They got nothin....." he said smugly...

Elsewhere that same night..

"Man this train is comfortable and quiet...I love this...I don't even drive in when I have a court case.. I ride the train into Center City.That's what they're doing...That's smart." said Dabnis, rearing back..

"Yeah I guess it is.. They'll be there on time." laughed Attorney Kayla Bennett_St. Jacques..

"Yeah, no  traffic jams and such." said her husband, Ray.

Our New Friends and building mates, Natalie and David Charles and Brooke and Sean Marks were already on the train when we got on...They got on a station before all of us...

THURSDAY MORNING- 9:00 AM

 

 We began our defense.....Yvette ,like Samantha was equally articulate...She knew how to cut to the chase and give jurors a simple definition of the defense.  Our client did not commit this horrible crime because, she simply was not there.  Yes she was seperated from her husband, yes she had hired a private investigator to get information on him and Kim Belle..but she did not kill him and Victoria Olsen....In fact...She didn't know Victoria Olsen...Victoria Olsen's name was never mentioned by Private Investigator ,Milt Lewis.

I held up her Smartwatch and used a monitor to show the jury where Ellie Mays was on the day at the time of the murder...

Bee Bee held up her Smartphone and showed a monitor which showed where she was on the day of and at the time of the murder...It matched her Smartphone..

Sofia presented her credit and debit cards and the charges made at a Diner and a gasoline station.

At the time of the murders and halfway across town....Far from the scene of the murders...

Kahlil called Witnesses from The Diner and the Gas Station who testified that they remembered seeing Mrs. Mays on the day of the murder...Both the Diner and The Gas Station were miles away from the Marriot in Center City...

Yvette surprised everybody by calling 

Jason Smith....He was surprised and embarrassed that he was being called.

He had to admit that Ellie Mays spent the night with him in South Philadelphia and that they both left

in the morning around the time of the murders....Ate at a Diner and then gassed their cars up at the gas station that Kahlil ,Bee Bee, Sofia and me talked about.

We could have closed our case then and there...but Yvette called Kim Belle...the other woman before this one..

We had subpoenaed her the very next day....beating Samantha and her team from doing so...

She was asked under oath how long she had been seeing  Mr. Mays (a year) if she knew he was married?(she did) was she in love with him?(She was...He had told her he was going to marry her as soon as he and his wife divorced.)

''Did you know about the existence of Victoria Olsen?" asked Ms. Yvette...

She hesitated to answer the question...

''Answer the question Mam!"said Judge Stiers..

She still refused to answer...

Her attorney H.Stanley Stanlison told her to answer the question...

She still refused.. She didn't realize it, but she was unwillingly providing vindication for our client...

more vindication...We had sufficiently proved that our client was nowhere near the scene of the murders.

Yvette said to her.

"Detectives and my investigator WITH A WARRANT, went to your apartment yesterday and they found this trenchcoat...

Which looks an awful lot like the Black trenchcoat one of the Prosecution's witnesses said they saw right after they heard gunshots.....

And this is a .38 smokeless revolver...registered to you, which matches the gun that killed Mr. Mays and Ms. Olsen...The police are going to test this and determine if it's the murder gun." said Yvette.

"On the advice of my attorney ,I'm not going to answer anymore of your questions on the grounds it may incriminate me." she said which further incriminated her.

More Unwilling Vindication.

"The Defense rests your honor."said Yvette ,smiling.

We had more than done our job!

Jade smiled at Yvette....We had over performed.

COURTROOM B- ONE HOUR LATER-

Judge Allan Stiers was surprised at how fast the jury came back with a verdict.  He was impressed with the lawyering on both sides.

"Has the jury come to a decision?" asked the Judge.

"Yes Your Honor, We have.."said the Jury Foreman, one of ADA Ortiz's picks.

She passed the verdict to the bailiff , who passed it to the Judge....He read it...His face was expressionless, betraying no emotion , one way or the other...

"Read it " he said.

"We Representing the Commonwealth of Pennsylvania in the matter of Pennsylvania  vs Ellie Mays, Count One on the charge of Murder in the First Degree of  Broderick Mays , we  find the defendent...,.NOT GUILTY!!

On Count two , on the Charge of Murder in the First Degree of Victoria Olsen...We also find the defendent, NOT GUILTY! 

 "We Did it? I knew we had THIS Case won..."said Yvette.

"OH THANK YOU, THANK YOU, THANK YOU ALL!" said Ellie Mays. she hugged and kissed 

Yvette, Me, Bee Bee, Sofia, Kahlil and Ms. Jade...."I love you all...when you come to my coffee shop, your coffees are always on the house." she said.

"You'll go out of business like that."laughed Ms. Yvette.

"I don't care...I owe you all my life, my freedom....

"OH THANK YOU, THANK YOU, THANK YOU ALL!" said Ellie Mays again....

" You're welcome....They didn't do their research..."I said.

"I'm really surprised... We know Lt. Tragg doesn't do his research...but didn't they have Ingrid Stevens on this case?" asked Bee Bee.

"They did but Lt. Tragg complained so much that they took her off at the last minute..." said Sofia.

''She would have found out what Jade found out."said Kahlil.

"We were sharing information at one point."said Jade.

Over in a corner across from us, ADA Samantha Addison was not so happy....

"You insisted that we take Ingrid Stevens off of this case...You insisted that your investigation was sufficient...Yet you did no back up, no recanvas and you didn't think to look at a second suspect as I asked you to. You really how do they say it in police jargon, Screwed the pooch" on this one."said Samantha Addison, a little upset that she had lost this case..

Lt. Tragg looked at her with a baleful stare.....

Melvin Ortiz didn't even look his way, he simply walked away...

"Come on girlfriend, join us tonight at Curleys..First Round is on me.."said Yvette.

"Couples Night!  I haven't been in Curleys in a minute...but I think on couples night...You should at least be a couple.... I haven't been dating since my divorce.....and the only prospect I have is Bruce Greene...I think he has a crush on me... He's kind of cute in a boyish kinda way." gushed Mandy..

"Take my advice, get as far away from him as you can."said Bee Bee..

"YESSSSSSSSSSS!" agreed Sofia.

Yvette smiled.. "My girls know." she said...  "Come on let's get outta here and go and grab some cold ones." said Yvette.

The gun, the .38 smokeless found in Kim Belle's apartment...turned out to be the murder weapon.....

Kim Belle was indicted and tried on two counts of Capital Murder....

Our friend Samantha Addison would prosecute her successfully,

Handing Attorney H. Stanley Stanlison a crushing defeat.... She was sentenced to two life sentences.

Our now former client, Ellie Mays stopped seeing Attorney Jason Smith shortly after the trial.. Yvette never said anything....but he could have been severely reprimanded for sleeping with a client...It just wasn't ethical...

But tonight we were all out at Curley's....It was Couples Night.....

"Vettie thanks for inviting me out tonight...I needed a cold drink and I needed to be out amongst people.." said Samantha.

 

 ''Don't mention it girlie.. The Trial is over....We can be friends again.." said Yvette with a smile.

"Especially since she's buying the first round."joked Gary..

"Melvin, we want you and Justine to come to our house for dinner in the next few weeks ." I said.

"Yes... Sofia and I will cook the meal.. Just come with your appetites."said Bee Bee.

"Gee Thanks Keith, Beatrice..."said Melvin Ortiz..

"Yes, thank you...We'll let you know." said Justine.

"It'll be a good time...." said Sofia.

"Yeah and hopefully we don't have to see either of you in court anytime soon."laughed Kahlil.

"So glad that case is over..." said Jade.

"I know you are honey." said Danny, putting his arm around her...

"Ummmmmmmmmmmm so nice and relaxing." said Virginia.

"Olivia , I see you've moved up the line..Got your own practice now and like Vettie got your own staff and a new husband.... My Girls have really come up."said Mandy..

"I have an Office /Duplex.....My practice is on the first floor..My niece ,Beverly and her husband live on the second floor and Me and my hubby live above them on the third floor.. We are right across the street from Vettie and her crew and Karen Page."said Olivia.

"And you...Beverly, I remember you....When you used to come to PENN to visit your auntie on some weekends...and when you told me you were going to law school....I see you did and you are quite the young lawyer...You and your husband."said Mandy.

"Yes I did and I, we both worked with my auntie in The Public Defender's Office."said Beverly..

"I met them when they opened up their law practice...I was the first person they hired... They put me through law school..."said Josie..

"And She put me through law school." said Paris ,looking adoringly at his wife...

"Olivia lectured at Middleton when I was a student there...She was my favorite lecturer...After I graduated and passed the bar, I interned for her..."said Bresha.

"Which led to a job."laughed Mandy..

"Exactly..."laughed her husband, Tony.

''Hi I'm Beverly's mother... Her father, Olivia's Older Brother is my baby daddy....This is my husband." she said.

''So this is your beautiful wife Rockland....No wonder you come to work singing everyday,." Mandy joked.

I just bought a house you know and I'm paying her way through law school, She's in her second year at Middleton ....This is my wife, Justine..Justine these are some friends of mine, Jasmine Coley, her husband, Dabnis Coley, Kayla Bennett-St. Jacques and Ray St. Jacques, her husband... All lawyer friends of mine.." said Melvin Ortiz.

"Oh pleased to meet you all." said Justine.

"Pleased to meet you Justine." said Jazzy.

"Ohhhh I've been married and divorced...at this law firm and that law firm and finally at The District Attorneys Office, where I see you are , but in a different capacity...." said Samantha.

"Yeah ,I work in the same building with Yvette...practically everybody here does...The Bridge Building..

I'm the head of the wrongful Conviction/Conviction Integrity Unit....And this is my husband, B.L. Benz." she said.

"Oh Wowww. Good for you, Good for all of you.... Your husband needs no introduction....I watch his show almost every week. That's partially how I've kept up with Liv and Vettie, from seeing them on his show." said Samantha.

"I'm going to have you on my show eventually..."laughed B.L.

Natalie had a slight buzz...She was sitting on her husband's lap...her head on his shoulders....

David was in pure heaven, holding her and sipping on her unfinished Martini.

"Look at them...they look so cute." gushed Brooke ,staring at Natalie and David.

"We could look like that, come over here and sit on my lap." said David..

Zoey passed her husband Lem a beer....

"Thanks baby!" he said.

Like Natalie , Renee had a slight buzz.....She was sitting on her husband's lap...her head on his shoulders....

Tyrell held her gently...as he sipped a cold brew..

Lee sipped two martinis straight...She had a slight buzz...She looked at Matthew and smiled..

"I love you." she said.

Nina was sitting on her husband's lap...her head on his shoulders....

Carlos kissed her forehead softly.....

A Mango Martini was delivered to Samantha...

"I didn't order a drink." said Samantha....

"The Gentleman over there sent it to you."said the Barmaid.

Bruce Greene smiled and waved...

"It's from Bruce Greene... I think he has a crush on me."sighed Samantha...

"Aren't you a bit old for him? You're about 9 years his senior, aren't you?" asked Olivia.

"He hit on me about two years ago and I'm nine years older than him...He should be hitting on Beverly or Jazzy or Kayla, Josie or Bresha...They're closer to his age."said Yvette...

"He's been coming on to me hard.." laughed Samantha....

"Run girl, run as fast as you can." said Yvette...as all three women laughed.
