Measure Of Success

 Shots rang out from the apartment complex in Little Norway...

I fired my .38 smokeless... A torrent of gunshots came my way....Letting me know there were two shooters... One with an UZI and another with a shot gun...

''Keep your head down Donnie Ray." said detective Duke Baylor of the Criminal Investigative Unit..

He and his partner ,Detective Tyriq Pyle, also of the Criminal Investigative Division

Also returned the fire aimed at me....

I had traced a gun sale, A Silencer, much like the one used to kill Richard "Ricky" White to a man named Victor Tracy, who was paid by someone in the Law Firm of .CLIMBER/HOROWITZ & STEWART, a large sum of money.. 15large to be exact...$7500.00 just one week before Ricky White's murder and another $7500.00 a day after the murder..

I went to talk to him and he refused to talk to me.. I found out from Lt. Sissy Van Buren

A Neighbor and good friend and head of the C.I.D. that he was a suspect in several area murders and that they had him under surveilience..I was with them on the morning they went to pick him up..only to be met by gunfire...Coming from Tracy and another shooter..a man on the roof with the UZI..

The second gunman on the roof with the Uzi had Detectives, Jimmy Barlow, Serena Pile and Tony Hopkins pinned down behind an unmarked squad car... 

They were firing back at him....

Detective Angie Belton was up in an apartment window on her walkie talkie..she was across the street from the shooter on the roof.

"Carlotta if you have the shot ,take it." she said.

Carlotta was in a window in an apartment right above Angie. With a Sniper rifle...Carlotta fired one shot...All she needed...She hit the man with the uzi center mass in his chest, killing him instantly...

 He pitched forward and fell off the rooftop into the street..

"My Girl Top....First round is on me tonight baby girl." said an ecstatic Duke Baylor...

The other man, Vic Tracy, who I wanted to talk to emerged from the alley cutting loose with several shotgun blasts that destroyed the windows of two unmarked squad cars..

He was met by a volley of shots from members of the Swat Team , who had come along with us...

He was killed also...

"I was really hoping we could take this one alive."I sighed.

"Sometimes it's just like that Donnie Ray."said Sissy Van Buren. As a former Detective myself, I knew this to be true.

They found a number of guns on Vic Tracy, including a pistol with a silencer... It went through a vigourous ballistics test and it was determind that this was the gun that killed Richard "Ricky"White and thus Ricky White was killed by a  hit man and not Colin Pollard.

I watched as the two killers bodies were put in white body bags and strapped to gurneys and wheeled away.

All this did was make ADA Bruce Green drop First Degree Murder Charges against Colin Pollard , but instead charge him with Conspiracy to Commit Murder which still held a life sentence if convicted.

ONE WEEK LATER-

COURTHOUSE WAITING AREA-

Our Client, Colin Pollard and Nelson, old law school chums went to get coffee for everyone this morning.

"COFFEE EVERYBODY, COME AND GET IT, DON'T BE SHY!" laughed Colin.

"GET IT WHILE IT'S STEAMIN HOT."laughed Nelson.

"Trial Day is finally here." said Nelson.

"Well we are more than ready..."said Josie.

"Yes indeed." said Bresha..

Bruce Greene walked in just then...He saw us all sitting and drinking coffee... He sized some of us up..

Beverly, very beautiful and voluptuous... Followed her Auntie into law...Worked as a Public defender before helping her aunt set up her own practice....Married to Nelson East...

who had worked with them at the Public Defender's Office...a Good move for him both ways, professionally and romantically.. He envied Nelson.

Josie, who had a Bachelors from Fisk and an MBA from PENN, before Olivia put her through law school.. She helped put her husband through law school...He felt as if Josie had married below herself...

Bresha, who married a man she had been in law school with...Also Beautiful and Voluptuous...He wished he had met her first...

And of course Olivia, once married to a Corporate Litigator and now married to me, an ex-cop, now her firm's investigator...He really felt Olivia had married below herself..

Of Course none of us cared about what he thought and he knew it!

COURTROOM C-

Kelly Anne Mercer was our Judge...We loved her...She was tough but fair and knew her law...but as sweet as pie otherwise.

"COMMONWEALTH OF PENNSYLVANIA VS. COLIN POLLARD ,CHARGE: CONSPIRACY TO COMITT MURDER!" said the Bailiff..

"Good Morning, Good Morning, Good Morning Attorneys and Jurors...I am Judge Kelly Ann Mercer..

We are going to seat a jury today and trial will start tomorrow morning... I know all of the attorneys involved...but would you introduce yourselves to the court please?" she said.

"Assistant District Attorney Bruce Greene Jr, and , a one time candidate for the District Attorney's office your honor." said Bruce.

"ADA GREENE!  That election was several months ago...You lost!  Are you going to remind us of that election everytime you are in court?  That gets very old you know." said Kelly Anne with a smile, that didn't hide her annoyance.

Beverly snickered... "Thank God somebody finally told him." she said. 

Olivia laughed in agreement..."Uh Olivia Bennett-Alexander,Lead Attorney for the Defense your honor." she said.

 

I sat quietly next to her...

"Beverly West-East-Attorney for the defense your honor."said Beverly.

"Nelson East, Attorney for the defense your honor." said Nelson.

"Josie Boyd, Attorney for the defense your honor." said Josie.

"And Bresha Billips, attorney for the defense your honor."said Bresha.

''Excellent and now we will go into Voir dire...Jury selection."said Judge Mercer.

Bruce was embarrassed and stung by what the Judge had said to him and a bit irritated , which he didn't try to hide.

He challenged the fact that Nelson had Josie and Bresha helping him...

Josie and Bresha both had laptops with notes on the jury pool and questions for Nelson to answer.

"They're not being disruptive and they aren't breaking any laws....I find no problem with them

being there...Your Motion is over ruled counselor, now get on with it." said Judge Mercer.

This really got Bruce's dander up. This really made the hairs on the back of his neck rise..

He was so angry, he was a bit off of his game...but not too much...

Nelson got a 7-5 split, including the jury foreman.

Olivia , Beverly and Colin were ecstatic!!

"Good work as usual Nelson." said Olivia.

"Excellent Baby!" said Beverly...

"Good Work Little Buddy...Professor Boudain would be proud if she could see you now." said Colin

Speaking of Law Professor Alice Bourdain, who had lectured them both and taught them at St. Johns University.

"You know she lives here in Philly now!" I said.

"She's a guest lecturer at PENN and Temple."said Olivia.

"Very Nice Lady." said Beverly.

"OUTSTANDING!  WE HAVE A JURY!   TRIAL WILL BEGIN TOMORROW MORNING!

10:00 AM...ATTORNEYS AND JURORS BE ON TIME AND BE READY FOR TRIAL!" said Kelly Anne. "COURT IS ADJOURNED!" she said.

Bruce Greene did his homework....He put his case together well-

"On October 30,2024, Amiee Stewart withdrew $5000.00 from her bank account..  The next day, Ricky White deposited $5000.00 in his account...Also on that same day,

Colin Pollard withdrew $5000.00 from his account and just hours later...Ricky White deposited $5000.00 into his account...

On November 15th 2024...Amiee Stewart withdrew $5000.00 from her bank account..  The next day, Ricky White deposited $5000.00 in his account...Also on that same day,

Colin Pollard withdrew $5000.00 from his account and just hours later...Ricky White deposited $5000.00 into his account...

On December 13th 2024, Amiee Stewart withdrew $5000.00 from her bank account..  The next day, Ricky White deposited $5000.00 in his account...Also on that same day,

Colin Pollard withdrew $5000.00 from his account and just hours later...Ricky White deposited $5000.00 into his account...

On January 24th 2025...like clockwork,  Amiee Stewart withdrew $5000.00 from her bank account..  The next day, Ricky White deposited $5000.00 in his account...Also on that same day,

Colin Pollard withdrew $5000.00 from his account and just hours later...Ricky White deposited $5000.00 into his account..." he argued.

It was his essential argument... that faced with his back against the wall...Colin Pollard had no excuse but to have Richard "Ricky" White, an admittedly unscrupulous charactor, who though an investigator for the same law firm was also a black mailer who was draining Colin Pollard dry.

We couldn't argue those basic facts and it wasn't anything we didn't know already..But we argued

that with all the money our client had embezzled and paid off his gambling debts with and then replaced in a short period of time.. It was highly unlikely that he had enough money to pay a hit man.

Beverly showed the juror photos of the Gun, 

the murder weapon belonging to the now deceased Vic Tracy....The actual murderer of Ricky White.

Nelson challenged the Prosecution to prove there was a connection between Vic Tracy and  Colin Pollard.   He ascertained that the two men had no connection at all.

Bruce produced a copy of an electronic bank receipt coming from the CLIMBER/HOROWITZ & STEWART law firm...  

"The payment came from the law firm's account, Pollard was too smart to make the payment from his own account.."said Bruce.

"That means Anyone, even the partners could have sent that order and that payment right?" asked Josie.

" Well uh ahhhh..Uhhhhhhh.." said Bruce Greene, obviously not expecting that...

Bresha showed the jury the gun with the silencer....She had police come up and totally confirm that this gun belonged to the slain Vic Tracy , a known contract killer, who was killed while resisting arrest last week.

I testified that I discovered an electronic payment made to him of $7500.00 coming from the CLIMBER/HOROWITZ & STEWART law firm...  a week before the killing and another payment made just one day after the murder...There was no doubt in my mind that Vic Tracy was the actual killer of Ricky White.

Olivia called Aimme Stewart to the stand..

She clearly didn't want to be here and she didn't want to talk about her affair with Colin...

"Aimmee When did you tell your husband you were being blackmailed and why?" asked Olivia.

"I told him a month ago....My personal account was empty and he noticed large amounts of withdrawals from our joint account." said Aimee, tearing up.

''Ricky White was Blackmailing you." said Olivia.

"Yes he was." she admitted..

"Did you know he was blackmailing Colin too?" asked Olivia.

"Not at the time...but I wasn't surprised when I found out he was." said Aimee.

 

"How did you find out?" asked Olivia. "About Colin?" she asked.

"Colin told me..." she said tearfully...

"What did your husband do when he found out?" asked Beverly.

"He was naturally furious...At Both Colin and Ricky, but moreso at Ricky for taking our money...

It took awhile but he forgave me and he told me not to pay Ricky another dime.. He fired Ricky, about a week before his death...That's all I know." said Aimee.

"He fired Colin too, did he not?" asked Nelson.

"Yes...He was enraged..."said Aimee..

Olivia called Chessley Stewart to the stand...

Chessley whispered something to his attorney, H.Stanley Stanlison...

H.Stanley Stanlison whispered something to him ,before he walked to the stand.

"Mr. Stewart...How long have you been a name partner at Climber, Horowitz and Stewart.?" asked Olivia.

"One Year." he said with a smile.   This was the only question he answered. Every other question he answered with.."On the Advice of Counsel...I will not answer that on the grounds it may incriminate me.. I am exercising my fifth amendment privilege...." he said.

''As a partner ,don't you have access to the account of the law firm? Can't you make payments to and deposit money in the account?" asked Beverly.

"On the Advice of Counsel...I will not answer that on the grounds it may incriminate me.. I am exercising my fifth amendment privilege...." he said.

 

He thought he was frustrating Olivia and Beverly, but he wasn't..

"Okay you don't have to answer....This is a Electronic Bank statement of a withdrawal and a payment to 

killer Vic Tracy, made by you....That is your account #,,,We know this because we have the account numbers of Mr. Climber and Mr. Horowitz and it's not theirs. You're the only other person who has access to the firm's account." said Bresha.

Chessley swallowed hard and began to breathe heavily...Still he said nothing.

Josie showed the jurors copies of the partners account numbers as opposed to his account number.

"You paid the hitman, Vic Tracy Mr. Stewart....You knew him because you represented him, when you were a trial attorney at another firm didn't you?" asked Nelson.

"On the Advice of Counsel...I will not answer that on the grounds it may incriminate me.. I am exercising my fifth amendment privilege...." he said again.

"Okay...Okay...No more questions....You can sit down Mr. Stewart." said Olivia.

Olivia called Colin Pollard to the stand.

He came to the stand...He stared daggers at his former friend and boss, Chessley Stewart.

"Where were you on the Thursday before the Murder?" asked Olivia.

"I was in Curley's Bar with you..."he said.

Josie and Nelson

Called Witnesses ,Curley the owner of Curleys and all of our friends who testified they were with him in the bar until 2:00

 

 

 

 

We were so happy they had taken time off from their jobs to come and testify on his behalf.

"Where were you after 2:00 am when you left ?" asked Olivia..

"I was at your house...I was in your basement apartment from 3:00 am until you saw me in the afternoon.." he said.

Bruce Greene pounced....

"None of you people saw him after 3:00 am.. He could have easily have left your residence Olivia and killed Mr. White.,"said Bruce.

"First off...Mr. Pollard is being accused of a conspiracy...Not of actual murder and we can prove he didn't leave the Alexander residence."said Bresha.  She called Ginger Anderson to the stand.

Ginger Anderson walked up to the stand....

"Mr. Pollard and I were together from a little after three until around 2:00 PM the next day.." she testified.

"WHATTTTTTTTTTTT? YOU WHORE!! WHORRRRE!!!  YOU WERE WITH HIM THAT NIGHT?? ARRRRRRRRRRRGHHH!" screamed Bruce Greene..

"ORDER!!! ORDER!!! ORDER IN THE COURT!!! "screamed Judge Mercer...

Bruce was still screaming to the top of his lungs at Ginger..

"YOU WHORE!! WHORRRRE!!!  YOU WERE WITH HIM THAT NIGHT?? ARRRRRRRRRRRGHHH!" screamed Bruce Greene..He tossed bhis suit jacket into the air and he spun around like a top...He kicked the table by him over, spilling the pitcher of water on the floor..The Jury was stunned.

"BAILIFFS...BAILIFFS...TAKE HIM TO THE COOLER....YOUR BEHAVIOR IS REPREHENSABLE...2 NIGHTS IN THE COOLER FOR YOU!!!!"screamed a rarely if ever rattled  Judge Kelly Anne Mercer.

Bruce became the first attorney she had ever thrown in the cooler for contempt of court.

"Come on...Let's get out of here."said Olivia.

 

" Yeah , I think we made our point today..." I said.

"Oh My God...Bruce in the cooler and for the next few days...hahahahahahahahahahahaha."laughed Beverly.

"WOW! Who would have thought it?" said Nelson.

"I feared her testifying....If we could have avoided it...We should have." said Josie.

"We made our point...We proved he was nowhere near the scene... and that he had nothing to do with any conspiracy..." said Bresha.

We left the courtroom.

While in the cooler...Bruce Greene is the recipient of Judge Kelly Anne's most stiffest punishment.

Only he could make this sweet woman impose such a penalty.

The Bailiff passed the envelope to Judge Kelly Anne..

She read it...She looked a bit agitated...Probably thinking about Bruce Greene and his behavior.

"Read it.!" she said.

"We the Jury of the Commonwealth Of Pennsylvania in the matter of Commonwealth of Pennsylvania vs Colin Pollard on the charge of Conspiracy to Commit Murder, we find the defendent, NOT GUILTY!"

"YES!!!" screamed  Colin...."THANK YOU!!!" said Colin.

"BABY! YOU'RE FREE!" said Ginger..

"I really like this place and it's so close to where we work." said Sofia.

"Yeah...Great atmosphere and despite it being Winter....It's warm in here.."said Kahlil.

"That's because they have heaters..."said Jade...

"We've got to come back here...Just me and you." said Virginia.

It was a nice place, with good food and nice cold drinks! 

"This place is so close to where we work it's a wonder we haven't all come here sooner." said Jazzy..

"Bev told me he freaked out when he found out that Ginger had spent the night with Colin, the man he was prosecuting." said Natalie.

"She was Colin's Alibi on the night of the murder."said David.

"He really didn't need an alibi for the night of the murder...They had identified the actual shooter...He was charged with conspiracy...He didn't have to be there."said Brooke.

"Yeah they really didn't need her testimony..But Bruce would've found out eventually."said Sean.

"Olivia told me he acted a damn fool, He screamed ,called Ginger a whore...jumped up and down and wouldn't stop screaming...Kicked over the table...."said Zoey..

"And caused that sweet Judge to get tough...She gave him two days in the Cooler.."said Lem.

"He's probably just getting out today..." said Renee..

"He could get in trouble for this." said Tyrell.

"I know right?" said Lee.

"Yeah." said Matthew.

"Nah, plenty of lawyers have been thrown in the Cooler for one reason or another.. I doubt he'll get in any trouble.."said Nina.

"If I know right...They were relieved he wasn't around the office."said Carlos..

We all laughed....

Chessly Stewart was indicted and went on trial for Conspiracy to Commit Murder...

He was represented by H.Stanley Stanlison...

After three hung juries...the case was dismissed with prejudice.... He was however fired from his firm and his name taken off the door.

Colin Pollard did find work at a small law firm in Bayside....Not far from the Hospital where Ginger works

He moved into a nice apartment complex in Bayside and soon she moved in with him...

Bruce got released from the" Cooler"

He spends a lot of time at Penns Landing..

Staring at the boats and the water....

A Day later...

"It's been a long time since you and I hung out...Just the two of us.."said Olivia.

"I knowwwww.... This Christmas shopping has me in the spirit."said Beverly...

"We've come a long way Baby girl... In the beginning it was just you and me and a dream....We made it work...We got a kick ass law firm...one of the best small firms in the city...We have neighbors and friends, a real community and we have great husbands who worship the ground we walk on...Who could ask for anything more? said a smiling Olivia.

"Yes, who could?" asked Beverly...

Unknown to them....Standing across the street and observing them was Elwood Barnes, Olivia's first husband....He thought of what he could have had had he of stayed with Olivia...Had he of been nicer to Beverly....

"Well , here come the others...."said Olivia..

"Yup" said Beverly...

 

"The Buses here yet?"asked Jazzy..

"They should be here in a few minutes.."said Olivia.

"Ready to go home?" asked Beverly.

 

"I'm ready to go grab some hot chocolate."said Dabnis.

"Ouuuuu me too!"said Kayla.

"I hope there is room on the bus for all of these bags and boxes you bought."laughed her husband, Ray..

"We've got plenty of room...Two Buses....You know how we women like to shop." said Jessica.

"Yeah, I sure do..."laughed Chip.

"We'll be alright..."said Karen...

"I see one bus arriving now."said Natalie..

"Last one to it is a rotten egg."joked David..

"Haven't heard that one since elementary school David." joked Brooke.

"We gotta stop some place for Hot Cocoa and Eats."said Sean.

"We will...Somewhere in our neighborhood." said Olivia.

"Good, I could use both."said Zoey.

"Why don't we stop by my house...I can hook up some hot cocoa and some snacks for everyone."said Renee.

"That's a great idea...We go home and put our stuff up and then come back to your spot."said Beverly, hugging her childhood friend.

"My baby loves to entertain.."laughed Tyrell.

"Ouuuuuuuu that sounds like fun." said Lee...

"The four of us can ride there in my car." said Nina.

"Good Idea." said Carlos.

"The Buses are on their way Vettie...We are all going to go home and unload and then go to Renee and Tyrell's house for Hot Cocoa and Snacks.."said Olivia.

 

 'Sounds good to me.." said Yvette.

"Sounds good to me too!"said Gary."You guys down for that?" asked Gary...

"Count us in." said Keith Jones..

"Yesssss."said Bee Bee.

"Hot Cocoa." said Sofia.

"Just what the doctor ordered."said Kahlil.

"Renee is the best."said Jade.

"That's why I bought her something extra special."said Virginia.

"That and she's your Polyanna."laughed Jetty. "Here comes your people Liv..And the buses too!"he added.

Both of our buses arrived!

"We were going to leave you.."laughed Olivia.

 

"No you weren't." I laughed and said.

"No we weren't...but we are all here now, we can start getting on the buses...We are going to start boarding...We are going home and unload and then head to Renee's house for Hot Cocoa and snacks."said Beverly.

"Great!"said Nelson.

"That's a good idea."said Josie.

"I could use some Hot Cocoa..."said Paris...

"I think we all could." said Bresha.

"Well, let's get on the bus.." said Tony.

"I'm ready to get off of my feet.."said Alfreda.

"So Am I."said Rockland as we all boarded the buses..

Bruce Greene stood across the street, unknown to us...Watching us all, laughing, happy and boarding the two buses with our Christmas gifts...He was a bit envious....He vowed that next year he'd have a girl, be buying gifts and have some of that happiness too!
