COURTROOM D- Tuesday Morning

Bresha brought coffees for everybody....

''Coffee everyone!" she said.

 

''Thank you baby" said Olivia.

"Thanks Bree." I said.

"Thanks Bree."said Beverly.

"Thank You Bresha." said Nelson.

"Thanks Bree." said Josie.

"Thanks Baby!" said our client, Uncle Robbie.

His very serious preliminary for his First Degree Murder case began today....If we could get him past this, he was home free....

Assistant District Attorney, Frederick Stockton, who we'd be up against stood off to the side of the room, with his own cup of coffee...

In Thirty Minutes, we'd all be in court  trying this case in one way or another..

Gennifer Lee, who we were still up in the air about representing in her suit against her former employers was in the corner kissing Lt. Tragg passionately....

''Am I seeing what I'm seeing?" asked Beverly..

"Must be because I'm seeing it too!" said Olivia.

''Olivia, your mama, god rest her soul had a saying about girls like that..She'd say they was hot in the panties." laughed Uncle Robbie..

Olivia laughed... "She did used to say that, didn't she.?" Olivia laughed..

Bresha and Josie laughed....

Gennifer Lee eased out of  Lt. Tragg's embrace and waved goodbye to him...She smiled and waved at us as she exited the courtroom.

He had her lipstick kisses on both of his cheeks and on his lapel...He seemed oblivious to all of that...His face was as red as a beat...and he had a pleased as punch look on his face..

ADA Stockton had some wet wipes in his pocket...He took one out and wiped Lt. Tragg's face off and his lapel, the same way Beverly would do me after I finished kissing Olivia..

''Straighten yourself up Artie, it's time to go to court.." He said...He knew who Gennifer Lee was, he had wanted to subpoena her as a witness, but we had beat him to it..and after reading the trial transcripts of the three civil cases she lost, he realized she would harm his case more than help it, so he thought better of it..

"Uh Thanks Freddie." said Lt. Tragg.

Lt. Tragg walked over to us....

"I understand you guys will be representing Gennifer." he said.

"That's not definite yet.."said Olivia.

"I understand she gave you a substantial retainer." he said.

''Which I still have in my possession...I may return it." said Olivia.

"May I ask why?" he asked.

"I don't believe that is any of your business man!" said Uncle Robbie.

"Button your lip pal, this conversation has nothing to do with you.."snarled Lt. Tragg...

"It has EVERYTHING TO DO WITH ME!!!...EVERYTHING!!! I WAS LIVING MY LIFE, RUNNING MY COMPANY, MAKING MONEY, ENJOYING LIFE AND BETWEEN YOU AND YOUR LITTLE TROLLIP, I'VE BEEN INVOLVED IN MULTIPLE COURT CASES, YOU DUMB, HORNY SHIT FOR BRAINS KEYSTONE COPPER!! Nelson and I grabbed Robbie before he and Tragg could get into anything... It was the first time I saw how very angry and distraught this whole thing had made him...Fighting in court for his business and now fighting in court for his very life on capital murder charges...It had all taken it's toll on him...

"Uncle Robbie...Uncle Robbie!!! Come on man, cool it!  We are at the home stretch baby, come on now..Don't let him goad you into yet another charge...come on now.."said Nelson...

"Yes...this is your last trial..We are going to get you off..You and zelda are going to be home free, I assured him." because I knew who the killer was...I was 90 percent sure, I knew who the killer was.

"Uncle Robbie come on now.....Come onnnnn...let's walk away...Let's go into the court room...Auntay can handle Lt. Tragg." said Beverly walking him away..

"Yeah Bev, walk him away...walk hm away before he gets himself hurt.."snarled Lt. Tragg.

''And to answer your question Lieutenant...It's none of your business. But my Uncle is right...you'd better take another look at your girlfriend.."said Olivia. "Come on ladies, let's go inside the courtroom."said Olivia.

"Yeah, Good Idea." said Josie.

"Here comes the judge anyway.."said Bresha.

Judge Jane Lynne walked by....She had missed the drama of a few minutes ago...She smiled at everyone and walked into the courtroom..

ADA Frederick Stockton followed her..

In a Condo ,just blocks from the courthouse....

Attorney  Dan Stevenson was at his condo...

''Where have you been? I haven't seen you in a few days." he said.

"I've been shoring up some legal help....I plan to sue the company...Not because I want my job back...I don't..but because I want some spending change...to the tune of 3 million or more..."said Attorney Gennifer Lee.

"You might not have to go that route...I've met with the Board on your behalf...They are willing to give you a severence one time only payout of 3.5 million and call it a day." said Dan Stevenson..

"Really? You worked that out/" she asked.

"Yes....I'm not a Harrrrrvard Grad like you..but I am a capable attorney you know." he said..

Olivia and Beverly and Nelson had been brilliant in the way they had tied him up and forced him to back up on certain things...

But Josie and Bresha were equally brilliant with their arguments and objections....It was a Chess Match, and a virtual standoff so far.

Lt. Tragg ,with no female for him to stick his hands under her skirt was a bit distracted...He fumbled with his phone the entire week, sending texts and phone calls to Gennifer Lee. His calls all went to voicemail and his texts were unanswered.

We all retreated to Sam Mother's Diner for Breakfast after trial..

We had a long table, Beverly, Nelson, Josie and Bresha were sitting along side of us..

''Yeah Me Neither..but he wasn't expecting us to be this prepared ." said Nelson.

"He looked stunned a few times when we came up with things."said Josie.

''We haven't begun our real defense yet...Liv told us to hold back some, Lull him into a false sense of security."said Bresha as she enjoyed her buttermilk biscuits with gravy.

Lt. Tragg walked in...He was in a frosty mood...He hadn't seen or heard from Gennifer Lee since Tuesday morning , when the preliminary hearing began...It was Monday.....

He marched over to our table..

"Where is your other client?" he asked.

"Uncle Robbie is right here at the table with us." said Beverly with an innocent, cheerful smile. She knew who he was talking about .She was being funny.

"Don't be smart...YOU KNOW WHO I'M TALKING ABOUT !! GENNIFER LEE!!" he said.

"We haven't seen her since last Tuesday Morning... She did send us a text Thursday saying she wouldn't be requiring our services...some Attorney named Dan Stevenson worked out an equitable buyout settlement with her former firm and she was withdrawing her lawsuit...So I had Donnie Ray mail her check back to her .She probably got it Friday morning..,"said Olivia.

''Dan Stevenson....Dan Stevenson?? Isn't that the guy who cleaned your clock in South Jersey the other night?? HAHAHAHAHAHAHAHA, Looks like he not only won the fight, He won the girl too! HAHAHAHAHAHAHAHAHAHAHAH!"said Uncle Robbie..

Beverly spit her coffee out,laughing...

Even Nelson, even tempered, Nelson was laughing...

Josie didn't try to hide the fact that she was laughing...

"Neither did Bresha....

Thin skinned lt. Tragg hated being laughed at and being the butt of the joke...

"Olivia, you need to tell your present client to keep his mouth shut..and teach your junior partners some respect." growled Lt. Tragg.

"The Bottom Line is Gennifer Lee is no longer our client..She has nothing to do with us...Now if you have nothing further, we'd like to finish our meals...That means without you standing over us..Now run along." she said tersely...

Lt. Tragg stood there defiantly staring at us with his baleful stare.

"You heard her, run the hell along , get the hell away from this table." said Uncle Robbie, who stood up angrily.

Lt. Tragg balled his fist up...

"THAT'S IT...I HAVE HAD IT WITH YOU!!" he snarled..

"ARTIE!! OUT!! GET OUT!  I'VE TOLD YOU ABOUT HASSLING THE CUSTOMERS!! OUTTTTTT AND YOU SHOULD THANK ME...I'M SAVING YOU FROM YET ANOTHER ASS WHOOPIN, GETTTTTTTTTTT OUUUT!" yelled Sam Mother from behind the counter.

"I know what I'm gonna do...I'm gonna find me another place to eat." snarled Lt. Tragg...

"Would you please?" said Olivia, not hiding her anger at Lt. Tragg...

Beverly whistled and clapped.

Nelson laughed hysterically...

So did Josie and Bresha.

Uncle Robbie whistled and clapped.

I just shook my head...

So did Aunt Zelda..

The Answer to where Gennifer Lee was , was simple...She had gone home, gotten an overnight bag and been staying in Dan Stevenson's Condo for the past few days...

Tragg, he really did a thorough investigation, considering...He interviewed all 100 of those people working in that bakery, two times...and he talked to everybody I talked to after that and interviewed the two other guys who lost their companies and checked their alibis too!  For him this was the most thorough investigation he's done in a long time...but both he and I overlooked the obvious...Walnuts in the mix..how did they get there? Since none of the cooks  recall adding them there had to be someone else...Someone else who was there , who had a chance to do it...and I found that person....I simply looked at their appointment schedule and then double checked with an assistant....Then I did a credit card and a debit card check and I found a fresh box of wet walnuts ordered that day.... I got to thinking about the last time Kelly Barnes fell out , when there were walnuts in a piece of cake she had at a banquet a year before..Again, the original recipe didn't call for it..and again this same person just happened to order wet walnuts the same day....and this same person was seen in the kitchen that day... Take a guess who this person was? The same person that's got Lt. Tragg strung out like a junkie...." I said.

"Lawwwwd, the power of the pantays...He'd never look that way, not in a million years...."laughed Olivia..

"Not in a million.." I laughed.

Beverly and Nelson helped us with the groceries and I explained the new evidence I had to them..

"She's still under subpoena.." said Beverly...

"She sure is...And she won't be expecting these questions..."said Nelson

as they sat at the table and had some tea with us..

"We've lulled Frederick along, given him a sense of well being, like he's got this in the bag...well we are about to turn his world upside down."said Olivia.

''And Lt. Tragg's as well , assuming he has real feelings for that girl.." I said.

"It serves him right for what he's trying to do to Uncle Robbie."said Beverly..

"Yes!" said Olivia.

I had known these two women for nearly a decade, they were my family...I had worked more cases with them than I could name...I had never known them to take a case so personal...but this was their uncle.

So After Beverly and Nelson left...

With Judge Jane Lynne we began jury selection...

No one was a match for Nelson...

and especially not Frederick Stockton...For the first time since this trial began, he began to feel uneasy, as if we had been holding back, lulling him into  a false security..

Nelson got all 12 jurors that we wanted...

He began the trial by naturally calling personel from the Medical Examiner's Office and policemen who were actually at the scene..

For two days, they bored the jury with the contents of Ms. Barnes stomach and relaying what killed her.

We didn't ask them any questions...there was none to ask.

Josie and Bresha asked the police on the scene were there any fingerprints or DNA evidence linking our client, Robert Bennett to the Scene...

Naturally they said no...Score one for the defense.. It was the first excitement...the jury had had all week.

He called our friend, Monica Seales, "The Skirt With the Dirt" who was interviewing Kelly Barnes on her TV show when she died... She gave an over the top performance of how shocked she felt to actually see someone die in front of her..

Richard Huff didn't want to be there but his testimony was word for word what he told me.."I wanted to kill Kelly Barnes...and Bennett said what we were all thinking and feeling, but didn't have the guts to say....We were afraid she'd do to us, what she did to him, fire him and kick him out of his company, thus he forfeited his salary and the works, so we were quiet...He fought back..He got your wife and her niece and they won him his company back....and so Mikal and I got lawyers and we fought back...Bennett had a lot of guts and determination...I've got nothin but love and respect for that man!! 

I didn't kill Kelly Barnes...I understand why you gotta ask..but I didn't do it....And I have an alibi...I was at the Egyptian Club with a date....and we went to a hotel afterwords...You can check my credit card receipts and ask..." he said. 

"I know, we checked... No further questions... We had no questions either.He was visibly worried that we didn't.

He called Mikal Perkeon...He too gave word for word testimony..."Look, Bennett said what we all were feeling and too afraid to say that day.... I felt the same way he did, that I had been tricked out of my company....I just couldn't prove it... I was overjoyed when I heard she was dead...but I didn't kill her and I've got an alibi....I was at Night Court fighting a traffic ticket...You can check!" he said.

"Yes, I did...No further questions." said Frederick Stockton....He gave his closing argument and closed his case.

Olivia, Beverly and Josie took the next two days on rebuttal to explain. They went through the contract and business history Kelly Barnes had with Robert Morgan's company line by line and dissected the agreement piece by piece pointing out irregularities and downright illegal business practices that the layman would miss or not understand...Which is why she was never challenged. People were intimidated by her Ivy leauge Attorney and just caved...They explained....

Nelson and Bresha explained that Robert Bennett had no reason to kill Kelly Barnes...They showed a legal affadavit she had signed just hours before she died giving his company back to him...and the financial renumeration was just a matter to be negotiated.. This had been worked out before She went on that show, using a cookie she had stolen from his bakery , trying to palm it off as her own...

We called Gennifer Lee to the stand...It was the first time we had seen her in two weeks...

Lt. Tragg hadn't seen her either.. He was livid that he had sent over 1000 texts and a little under a thousand calls and they hadn't been answered....but so horny for another romp in the sack with her that he was willing to let bygones be bygones...

"You and Kelly Barnes grew up together...She was constantly over your house right?" asked Beverly..

"Your mother won all of the local Baking contests in the area during the time when you were growing up, didn't she?"asked Olivia.

"Yes, she did..Cooking was her life."said Gennifer proudly....

"Were you aware that it was your mother's recipe that Kelly Barnes used when she launched her company/" asked Olivia.

"Not at first...but once the cookies were manufactured and we bought some, we knew it..Me and my mom!"said Gennifer.

"How did you feel when she took her company public and became a millionaire..a multi-millionaire and got her picture on the cover of magazines , was on television and everything...How did you feel/" asked Beverly.

"My mother was heartbroken....She felt, she felt as if she'd been stabbed in the back by a friend..That's why I decided to become a lawyer to stop things like that from happening to people." said Gennifer Lee, now becoming emotional..

"And yet you worked for her, you were her number two...The person who stole your mother's recipe and gained fame and possibly drove your mother to suicide..."said Nelson...

"I have a receipt here for Wet Walnuts that you bought on the day of Kelly Barnes broadcast....You were at Robert Bennett's bakery on orders from Kelly to steal his new cookie, "The Everything Under the sun " cookie...She was going to debut it...You went there with a fresh bag of Wet Walnuts and when no one was looking you poured them into the batch just before they were baked. Didn't you?"asked Bresha.

Gennifer was visibly angry....She was shaking and she was smiling....

"I have a receipt from another supermarket for wet walnuts purchased by you a year before , wet walnuts that showed up in a cake that almost did Kelly Barnes in...You tried to kill her twice didn't you?" asked Josie.

"Co-Incidence?" asked Olivia.

"I think I'd like to speak to legal counsel before I answer any more questions like that."said Gennifer, smiling sweetly...Gennifer really liked Olivia, she thought she was a smart woman and an excellent lawyer..

Olivia smiled at her...

"That's a good idea...You're a very smart woman." she said. "The Defense rests your honor." she said.

ONE HOUR LATER-

"Has the Jury come to a conclusion?" asked Judge Lynne.

"Yes we have your honor." said the forewoman.

The Bailiff brought her the decision... She read it , then passed it back to the Bailiff..

"Read it." she said.

"IN THE MATTER OF COMMONWEALTH OF PENNSYLVANIA VS. ROBERT LOUIS BENNETT. COUNT ONE, COYNSPIRACY TO COMMIT MURDER, NOT GUILTY

COUNT TWO MANSLAUGHTER, NOT GUILTY

COUNT THREE, SECOND DEGREE MURDER, NOT GUILTY

AND THE MOST SERIOUS COUNT, FIRST DEGREE MURDER, NOT GUILTY!

''Thank you for you attention to this matter..Jurors , you are dismissed!" she said.

''Olivia, Beverly, you guys did it! I knew you'd do it...WOW!! Things are back to normal...Come here baby!" he said and grabbed his wife..

"OUUUUUUUUUUUUUUUUUUU!" said Zelda as he pulled her to him 

and kissed her passionately....

"Ouuuuu I feel good.. I feel vindicated!!!!I feel like we lifted a big weight off of Uncle Robbie forever, that weight being Lt. Tragg's persecution."said Olivia.

'We found a way and we did it." said an exhausted Nelson..

"I had no doubt we would pull this one out, especially after Donnie Ray told us what he'd found."said Josie.

"Same Here. We work well together...We're a good team."laughed Bresha.

"Yes you guys are."laughed Kayla who was with us today to celebrate the end of the trial."

"Kid, I've been calling and texting you for days...I've got to see ya."said Lt. Tragg.

''Arthur...Arthur....I'm busy...." was all she would say as she rushed past everyone , out the door...

Leaving Lt. Tragg standing there, staring balefully.. He watched as Olivia and I, Uncle Robbie and his wife Zelda, Beverly and Nelson, Josie, Bresha and Kayla all walked out of court jubilant and happy!

"HEYYY LET'S ALL GO SOMEPLACE AND CELEBRATE...WHERE OLD DEPUTY DOG WON'T BE/" said Uncle Robbie..

"Is there a place?" asked Aunt Zelda.

"I'm sure there is...As long as Gennifer Lee doesn't show up."said Beverly...

"My Guess is she isn't trying to be seen in public tonight." said Nelson...

"Yeah, she might be headed for the city limits." said Josie.

Bresha and Kayla busted out laughing...

"Come on Artie...You look like you could use a cold one ." he said.

"You go ahead Freddie..I'll catch up." said Lt. Tragg as he stood alone ,long after court had cleared out..

Gennifer Lee wouldn't be seen for another year, when she was arrested by the FBI in San-Francisco and

extradited back to Philadelphia.. She was tried and convicted of the First Degree Murder of Kelly Barnes. She was disbarred and sentenced to Life without Parole.

But that Night after he was acquitted of murder charges,  we took Uncle Robbie and Zelda to a place they could relax and not have to worry about Lt. Tragg.

Josie's Bar and Grill  where the drinks were cold...

and plentiful and cheap!

and the band played loud and long... Tonight the band was from Camden..These guys were pretty good...They were cooking...

and the place was jumpin and packed!

"You said you wanted a place where you absolutely don't have to worry about running into Lt. Tragg Uncle Robbie...Well this is it..Our neighborhood bar, Josie's.." said Olivia.

"This is where we all hang out the most..." I said.

"Well I can see why!This is my kinda place and the perfect place to celebrate my freedom and my control of my business...Though I kinda would have loved to have rubbed it in ole Tragg's face.."said Uncle Robbie.

"Oh don't worry about him...Let's not let him live rent free in our minds or conversation...He's not here, so forget about him." said Aunt Zelda .."Come here, give me a kiss." she said.

''Well alrightttttt" he said and they kissed passionately..

"I'm sooooo happy for Uncle Robbie, we got him his company back and got those murder charges dropped. He's completely vindicated! "said a very happy Beverly...

''All in a days work."said Nelson.

"Now let's enjoy some cold ones..."said Josie as she and her husband, Paris toasted...

"I'm all for that."laughed Bresha..

"I'm all for you and this dress...lawwwwd!"said her husband, Tony.

"Be Nice...If you're good , you'll get to see what's under it when we get home.." cooed Bresha seductively...

Alfreda laughed..."I told you that dress was gonna get you in trouble girl.." she said.

"This one you got on might get you in trouble."said her husband, Rockland, who as usual was salivating over her...

"Lawd knows I'm having a great time."said Uncle Robbie.

"You deserve it Uncle Robbie."said Kayla..

"Yeah man...Tomorrow , I'm comin by your Bakery and buy a dozen doughnuts." promised Ray....

" I need a Cake for my hubby's upcoming  birthday.."said Jazzy...

"Ummmmmmmmmmm yes...!" said Dabnis....

"And I see they make Churros too!" said Jessica.

"That'll be right up your alley babes."said her husband, Chip..

Yvette had been Olivia's law school room-mate and had been around the Bennett FAmily enough that she considered Robert her Uncle Robbie too and he often spoke of her as his "adopted  niece", just like Beverly and Kayla considered her their "Auntie" allowed herself  to say.. "I'm happy for Uncle Robbie, tonight is his night and it won't be spoiled by anyone..." she said.

"Nope Not in here..." said Gary....

"Hey tomorrow ,let's go and check his bakery out." said Keith Jones..

"Yeah , they bake Churros...we'll get some for Sofia.."laughed Bee Bee.

"Like I'm not going with you huh? You know I am."laughed Sofia.

"Once you said Churros, you knew she was down."laughed Kahlil..

Jade said nothing...she just leaned her head into her husband's shoulder.

Danny smiled serenely....

''I know Jade is giving Danny some good lovin...He don't say a word...He just sits there and smiles."laughed Virginia...

He took her into his arms and kissed her passionately...

"Alls well that ends well huh hubby?" said Zoey...

Brooke sat on her husband's lap and leaned into his shoulder..

While at Penns Landing.....

an off duty and slightly drunk Lt. Tragg looked at the river and sipped on his favorite Irish Whiskey....and wondered what had happened.. Not only had they lost the case , but Jennifer had dropped out of sight...He went by her apartment...She had moved out and left no forwarding address.

What a rotten week for him!

He looked at the full moon and just shook his head!
