ONE WEEK LATER!
It was as if it were a whole new trial...We had a new Judge..
Judge Keith Morrison, who we knew and had worked with before...He was tough and fair...He knew the law...He generally liked us..
Nelson and Josie were up against
Assistant District Attorney Susan Knight on Voir Dire, picking a whole new Jury...She gave as good as she got and she understood the game and how it was played.Roscoe Jenkins was once again lead counsel for the defense with assistance from
Olivia Bennett-Alexander
Beverly West-East
Myself, Donnie Ray Alexander
and of course our lovely intern, Bresha Williams. Bree was getting one hell of an education and was enjoying the new friendships she had made and the fellowship.
Our client, Johnny Honeywell had reason to hope..When he was first arrested...He didn't have money for a lawyer...He was destined to get an inexperienced Public Defender , who would maybe plead him down to a lesser charge and he'd spend close to 20 years in prison for crimes he didn't commit..or maybe the rest of his life, again for crimes he didn't commit. He hadn't raped any women and he didn't know the dead woman, had never before seen her in his life, he said.
Then famed Criminal defense Attorney,Roscoe Jenkins,
read about his case in the paper and agreed to represent him Pro Bono. He felt "this boy was being railroaded. I have to do something to help him." he said.
Then he wound up before the most difficult ,tyrannical judge in the system, Merlin Merkins..and he thought..Maybe he wasn't so lucky at all...Especially when he tossed his attorney in the cooler after several arguments for contempt..
He thought he was destined for a Public Defender, when his angels showed up..
Olivia Bennett-Alexander, Beverly West, Nelson East, Josie Boyd and Bresha Williams and they even had an investigator, Donnie Ray Alexander to check things out...That was his lucky day and with the nasty old Judge in the hospital and off the case , and three rape charges dropped..He was in court now with one charge...A Murder charge...He was innocent of that too...All of his attorneys in his corner and a new judge, a Black judge...He looked and felt confident that he just might get off..
His side had gotten seven out of twelve jurors they wanted...
''Alright, the jury has been seated...I don't want to hold this thing up any longer.. Trial begins the day after tomorrow at 10:00 am..Be on time and be ready for trial." said Judge Morrison.
Assistant District Attorney Susan Knight, had used the two weeks before to retool her case against Johnny Honeywell..Now only on trial for murder, the Murder of Helen Green, with a new jury that knew nothing about the rapes he had previously been accused and cleared of.Unfortunately, she still had to work with Lt. Tragg..The two barely spoke to each other in the days leading up to the trial...He was just as angry...Angry that Judge Merlin Merkins , who he regarded as a tough no nonsense Judge had had a heart attack and thus removed from the trial. Angry that Olivia and Beverly and crew had joined the original trial lawyer to take up the case and angry that he had been wrong about the Queen Village Rapist charges...Another suspect had been caught and had confessed. He almost needed Honeywell, who he was sure was guilty of something to be convicted, so that his entire investigation wouldn't go bust...If Only Judge Merlin Merkins had stayed on this case, he wouldn't have taken any guff off of Olivia and Beverly and he might have jailed the whole crew..
But Judge Merkins had his own trouble right now..Where he was about to faces multiple charges of racial discrimination in a class action suit taken against him...
Attorney Yvette Jones -Lockwood walked up to him.,...She was flanked by two of her associates..Keith Jones and Beatrice Evans and her investigator,
Yvette smiled.. "You don't remember me do you? Years ago...When I had been practicing law for maybe three years, might not have been that long...I tried a case in your courtroom...You objected to everything I did and was so biased toward the Prosecution that even the Prosecution was surprised..
Assistant District Attorney Susan Knight was good, she was glib, a great storyteller and very knowledgable of the law... She told the jury that the client, Johnny Honeywell, a registered sex offender strangled Helen Green because she rebuffed his advances in a bar, a week before... He killed her where and when he did because the neighborhood was upset and on alert about the Queen Village Rapes...He figured if he killed her now, that crime would be lumped in with the rest....But it backfired on him, she said. he was arrested and charged with all of it...when the actual Queen Village Rapist was captured, she argued...He unlike Johnny Honeywell had a rock solid alibi, he was in Kensington, raping a fourth woman. she said, This brought laughter from the jury.
Bresha, our intern, brought in a couple of experts who looked at the lititure marks on the neck and ascertained that Ms. Green had been grabbed from behind by a left handed person and strangled..
On Cross, Roscoe,Olivia, Beverly and Nelson compared their testimony today to interviews they had earlier with Lt. Tragg in which they said they weren't sure who Helen Green was talking to...In which they said it was a dark skinned Black man, in which they said that rather than being rebuffed , she and this "dark skinned black man were kissing very passionately.."
Susan Knight argued that John Honeywell liked white women...She brought up his juvenile statuatory rape of a 15 year old when he was 18 that resulted in her pregnancy and an abortion...
"Because she's got nothing and she knows it...We haven't even begun our defense yet and we've destroyed most of her case."said Roscoe.
I agreed...he was right...
"I've known her about four years...We drink at the same bar, Dirty Louie's." she said.
"It's in the autopsy report.....right here... Alcohol mixed with a large dose of barbituates..."said Olivia, smiling. "You can't fight the science baby." she added.
"No Further questions." said Olivia, smiling.
Roscoe Jenkins gave his closing argument..
ADA Susan Knight held her head in her hands...She looked sick..She knew she had lost the case ..She turned to Lt. Tragg...
Lt. Tragg got up and simply walked out...He was furious!
"You're welcome son... But the real thanks goes to Mr. Donnie Ray here...Mannnnnnn I could have used a great investigator like you when I was practicing...You did the damn thing." said Roscoe.
"You're quite welcome...I was only too glad to help." I said.
"And thanks to these bright young, brilliant Attorneys....I am so glad to have been able to work with you guys.."said Roscoe..
"Thank You...I was honored to work with a legend such as yourself."said Olivia.
"Yesssss, you taught us a few things."said Beverly.
"Indeed...I surveyed the jury...We got a 12-0 slam dunk for acquittal...I'm sure." said Nelson.
"That's a great sign,"said Josie.
"Yes indeed." said Bresha..
She saved the best or worse, depending on how you looked at it for last...In which she showed Him bullying Attorney Kayla Bennett-Sat. Jacques so bad...she burst into tears and the court had to recess until she got herself together...
Judge Merkins looked sick..He couldn't believe he had been removed from the bench...He had been a Judge longer than he had been an attorney...He loved striking terror into the hearts of Attorneys, he loved the nearly unchallengable power he had over people's lives...Making sensitive female attorneys
"YESSSSS!" Johnny yelled, pumping his fists, his long ordeal was over...He was a free man... he hugged Beverly, Olivia, Josie and Bree and kissed them all on the cheeks..
"You're welcome!" said Beverly, smiling.
"We always love happy customers." said Olivia.
"You're very welcome" said Josie.
"You're so welcome.." said Bresha..
"Thank you sooo much Mr. Jenkins..He said , hugging him for a long time..
"You're welcome, just keep on achieving son.." he said.
He shook Nelson's hand...
"Of Course they did...The way you loused up this case what did you expect?" said an angry ADA Susan Knight.
"Judge Merlin Merkins lost that suit...He's been removed from the bench..."said Lt. Tragg trying to pivot away from the subject..
"So what? He was a jerk." said ADA Susan Knight as she walked away ,declining to talk to the press..
we all fielded questions and quickly left the building...They had told us that the original Judge, Merlin Merkins had been removed from the bench....We were all ecstatic..
Defending Attorney Roscoe Jenkins from a Contempt Charge that kept him from defending his client..
Nelson, Olivia and Beverly argued beautifully that the Judge's behavior not only to Attorney Jenkins was so reprehensible that there was hardly any precedent for it.. Hardly any, they came with two trial transcripts and two predicates which they argued dealt with judicial misbehavior of his type...
"You are out of your rabid mind you nasty evil old coot!.."said Beverly, holding her aunt back.."Now you've gone too far buddy...I'm gonna rip you a new one.." I said.
"Not if I get to him first." said a furious Nelson...
"No...Not like this.. Josie's right..He's not worth it."said Bresha., who joined her and stood between us.
"He's done..He's defeated. He's got nothing " said Judge Wong ,who also got in between us...
''Don't you see, the man is sick he needs help, pity" Sean Shotwell pleaded to the Ethics Board members. "He's not in his right mind..I implore you to reconsider your motion....You've already removed him from the bench." he said.
"Awwww shut the hell up.... I pay you top dollar and you lose BOTH OF MY CASES!" snarled Merlin Merkins., who punched Sean Shotwell, knocking him into the table and knocking over the punch....which splashed all over the floor.
''We won in a big way..We got that mad man off the bench and out the game for good...I'm so glad I met you guys and got to work with you..." said Attorney Roscoe Jenkins.
"Yes...it was a great experience.."said Beverly, rubbing my shoulder.. I was still seething mad at Merkins.
"It was great working with you."I said.
Beverly and Josie both were trying to calm Nelson down, he still wanted to go after Merkins..
I took her in my arms...
